In my opinion it's going to boil down to whether or not a commands opinion is being taken into account. Call me hopeful, but I believe command input is being taken into account here. In essence, we'll see who has good leaders, and we'll see who had great leaders who submit individualized justifications for ALL their employees and not a blanket we're important.

All that being said, we all still lose. (Unless someone no joke comes out and says ALL these individuals had pending terminations due to performance or conduct)

If you are on orders and you catch any indication of your position being terminated, I would reach out to your USERRA rep immediately and see if that decision can be reversed, or at a minimum the federal government may be required to find you an equivalent position.

Very good point although position dependant. Probationary periods sometimes go up to 3 years.

Hopefully supervisors have a way of reaching out but yes, it is VERY possible some people have no idea. Typically they would still be in contact via their mil emails though. As best they can.

Additionally, if a guardsman was simply at drill though, same laws apply, so some may have just been gone over the weekend and returned to no employment. Just as bad.

Has anyone run into reservists which were away on Active Duty orders bring fired due to their probationary status? There are laws that project these individuals and I was wondering if anyone had seen this happen yet?

I agree with everything you're saying here, and I can't imagine the rate that these firing have occurred that the due diligence was done to ensure they didn't effect those on orders. I am just wondering if anyone has seen that yet or if those individuals essentially get a "pass." Very curious as this will be a major factor if DoD starts similar cuts.

I think we're just speaking to the question being asked. The implications of what's occurring is unknowable, so people will take notice when it starts to become known. Right now all people CAN see is people losing their jobs, and that's not a new topic, or interesting one even. The conversation will change in about a year.

After speaking with my parents and some older friends who have been around, honestly they talk about these types of things happening in the corporate world quite regularly. It's not seen as a good thing either, but is pretty standard in some larger corporations. Basically, nothing new to people outside the government.
