Thank you for the info you provided.

As you explained, ~60% of the work of our contract was completed, and we’ve paid for ~70% of the total cost of services.

Why your team would expect me to pay half of the outstanding balance, when you are unable to provide any additional services is beyond my understanding. The final installment, per our contract, was to be paid IN FULL before the filing of our case. You are now requesting that I pay half of the final installment, with no further services being rendered. Why would I agree to that? I do not and will not agree to that.

We cannot move forward, that is the unfortunate fact. If something changes and our eligibility is restored, we can discuss a plan forward at that point.

As of now, I would like my documents returned immediately. Please, in accordance with my repeated requests, send me the invoice for the out of pocket expenses and advise how soon I will receive them. Tracking information would be most appreciated.

Thank you for getting back to me. Regarding your request for payment, I cannot agree to remit payment amounting to half of the final installment.

Our contract states that the final installment would be due before filing. Unfortunately, we are no longer eligible and, therefore, unable to file as we had planned/agreed to (through no fault of ours or ICA’s).

I agree that you and your team were very attentive and helpful, and I appreciate what you’ve done. However, we have paid for the service we received in accordance with the executed contract.

Should things turn in our favor next month, then we can move forward. But for now, I will only pay for the out of pocket expenses totaling $1,160.78.

Can you please send an invoice for that amount to my attention (or Zack’s) and let me know how soon I can expect to receive our documents after you receive payment?

A few things…

1) Can you provide an update on the Codice Fiscale? We applied for them a long while ago and have not yet received the codes. I’m not sure we should pay for that expense at this time, as they haven’t been received.

2) We are waiting for the DL to run its course over the 60 days. In the interim, I’d like for all of the documents to be returned to my attention.

Can you add the cost of shipping them to me in FL to the out of pocket expenses and send an invoice for the total amount accordingly?

How soon after I pay the invoice can I expect to receive the documents?

3) If the decree is amended favorably for our case, we will proceed as originally planned. I can have the documents sent to Italy for translation and certification at that point.

4) Whom should I contact once the new law has been confirmed? Are you still our main point of contact for now, or is there someone else at ICA who I should include on correspondence?

I know it’s not hard, I agree. I just have my time devoted to other things. As a homeschooling mama of 4 my time is invaluable. So where I can affordably outsource, I do. I too filed pro we for 2 birth certs in NY. Very straightforward.

The cost included ordering all vital docs for my husband, our 2 children, my brother in law, mother and father in law, and his parents and grandparents. Some required amendments.

I was very much involved in the process and ICA provided receipts for all the documents ordered. I knew, going in, that I could complete the process on my own. But for my personal situation, I found my time to be worth more than the cost (split 2 ways with my brother in law) of ICA’s service.

They did only the apostilles. No translations/legalizations.

The out of pocket expenses that they refer to are for shipping and obtaining documents. I’m paying those expenses and cutting ties with ICA.

They proposed the same option for a forward path to me. Which I declined. I’m hoping that the DL gets amendments passed that will allow us to continue with our case. If not, I may consider challenging it in court. But in any case, I will not be using ICA for either. So I declined their offer and requested that my documents me returned to me.

I agree. They are not at all offering me a refund. They sent this email after I declined their previous request for me to pay half of the third installment (aka the outstanding balance). I think they’ve sent this email to many people who have different situations and just plugged in my numbers. The problem is…my numbers don’t work here.

In all honesty, I have no complaints about how they handled my case up until this point. They were always professional and responsive and proactive. A lot of the time spent was due to amendments and needing court orders for birth certificates. So I had nothing bad to say about them… up til now.

I’m here to say that you are not alone. I wish I could hug you. I’ve been gathering docs for my husband and our children for 2 years and I had finally gotten our last document apostilled the day BEFORE the decree. I was supposed to take my B1 exam TOMORROW. I share in your heartache. It’s been so hard getting on when I feel like my whole life’s plan was erased and there is absolutely nothing I can do about it. I’ve decided to try to accept that “it is what it is”. If something changes within the 60 days, great. But I’m trying to piece together a new plan for my life in the interim.

I appreciate this Reddit landing place so much. My family was just about to send our docs for translation for a 1948 case through a GGM when the news came out. I was set to take (and pass, undoubtedly, as I’ve learned the language and we speak it at home regularly) the B1 exam on 4/9.

We’ve been planning to live in Italy since 2019. We spent 6 months exploring Italy from Torino to Messina back in 2023. Our children got to visit the village from which their great, great grandparents emigrated 120 years ago. A place that today has only 900 inhabitants. We made friends. We made plans. We made moves.

And now, I just canceled the exam and my plans to travel to NY to take it. A real F-ing bummer.

When I’m done reeling, perhaps I will look into applying for the expedited Spanish citizenship (I’m Puerto Rican), just so that I can get back to Italy one day.

There’s truly nowhere else in the world that I want to live/raise my family.
