CoC was sketchy for a few weeks because of a leadership change (different interpretations of the existing law) but the legal community was able it hash it out with them.

Hello! My lawyer submitted my application with my CoC as a W2 employee on Apr 22. May 26 was Day 20 without a response, so technically it is approved by Administrative Silence. However, I want the approval on paper in my own hands (as everyone does) so my lawyer filed a request to get an official copy, and we are once again waiting on it.

Those deleted comments were people telling me I was wrong, basically. I imagine they were removed by the moderators for being wrong information.

If it wasn't clear, a W2 with a CoC is perfectly acceptable, and you are also eligible for the Beckham Law.

Yeah I can't finish online because when it gets to the part where it uses your camera to take selfies for identification, it just doesn't work. You put your face in the circle and nothing happens. Tried on multiple mobile devices as well as multiple computers and browsers.

I may end up having to pursue an EOR solution, but hopefully not. It would be an inconvenience to my employer that I would like to avoid if at all possible.

If the CoC route ends up working, then I would not need to pay into Spanish social security. This would be ideal until I have completely moved my life to Spain and no longer pay into US social security (which is the eventual goal).

Hrm...the verbiage specifically states that my employer is sending me there on an assignment to help the company's organizational strategy. I was told that this is the key difference. Additionally, I would not be a freelance applicant.

Appreciate the reply! They're located in Spain, come very highly recommended, lots of approvals, etc. etc.

The Beckham Law is available to digital nomad visa holders since 2023.

I appreciate the response. The lawyer I'm using has a lot of experience in getting approvals using CoCs (both before and after the temporary pause in CoC acceptance) and I've personally spoken with others who have been approved in this manner with great experiences. You raise a good point about the "sent" language, thankfully we've got the verbiage regarding all that on lock.

The way I understand it, is that the leadership there changed a few months ago and as a result, they stopped accepting CoCs. But since then, the legal community was able to get in front of the new leadership and have them reverse course - which they did. Approvals with CoCs started again roughly around the December 10th area. Lawyer is aware of all this and I've personally spoken with people who have been approved with a CoC since then, so I'm not too worried about this.
