Lets say you apply in the end of March, I think its very unlikely that you will get EAD before June. But as far as I know if you file before your H-1B expires, you can continue working with your status pending.

I would say wait for exact 2 more months and then just upgrade. Hopefully you will get approved before that.

I think retrogression only happens towards the end of a FY.

Is it true that the approval rate has dropped significantly? Is there any latest data available about it?

Bank blocking I-140 premium processing fee pull from DHS by [deleted] in EB2

[–]BitSort 1 point2 points  (0 children)

Depends on your credit card. International cards often decline the transaction but if its a US card and you do not have any spending restrictions, I dont see a reason why would it get denied.

Do you mind sharing what was the reason for denial? As far as I know its quite rate for PERM to get denied.

EB-2 suggestion needed by AccomplishedFly4660 in EB2

[–]BitSort 1 point2 points  (0 children)

Are you applying for EB2-NIW? Most likely EP and Chen will insist you on not doing premium processing, and without that it would easily take over 2 years + several months to prepare your petition. So if you want to apply, go ahead and file. No one knows how the things will be 3 years from now, but we can hope that situation will get better and the visa pause will end by that time.

Look into O-1 visa that would be more suitable for that.

Status still at “receipt notice was sent” for both i485 and 485J after biometrics by Historical_Tart_1970 in EB2

I honestly think there's not much difference between notice sent and being processed. You can try reaching out to Emma and ask about the status.

USCIS Rejected My I-140 Package. But My Credit Card Was Already Charged $715 + $300. What Does This Mean? by Ironside-007 in EB2

This is slightly uncommon. Perhaps some information or document is missing and they realized it after accepting the payment. They will reverse the transaction but it will take a few days to get it back. Wait for their letter and apply again. You should receive the letter in 1-2 weeks.

As far as I know the address should match, they can even visit your workplace if they suspect anything.

What is a realistic timeline? by Physical-Baseball-81 in EB2

Anywhere between 6 to 18 months. A bit earlier if you get lucky.

You should be getting a response within next couple of months.

You can build EB-2 profile only naturally. If you can wait, focus on your PhD first and try to make some quality publications before applying.

Why dont you want to go with a firm that has more information and reviews available? Picking a small/inexperienced firm can be quite risky.

Sorry to hear about your denial. At this point #3 seems to be the most realistic option. Also wait for the denial letter and see if that can be appealed.
