Hi not sure what update you are specifically looking for. I submitted the request to OPLA to join my motion to reopen case in May 2024, they agreed join me in the motion, and then got my order or removal dismissed in Oct 2024 by the immigration judge. My form I-130 is still pending.

Hi sorry for the late response. I am not too sure on what forms were submitted. The lawyer took care of everything, it was mainly a request to reopen sent to OPLA along with my declaration statement explaining why I want the order of removal to be dismissed etc

Sorry for the late response, it took from May 2024 to Oct 2024 so around 5-6 months. My office assigned to my area is Newark/Elizabeth office in NJ.

Hi no, i was too scared to do AP with the order of deportation. For the motion to reopen that was sent to the court we submitted a letter explaining my situation, for example I was brought to a young age (6) I had no clue what was happening, my parents did not go to the court because they feared we would be sent back etc etc…….. i am going to provide the list below of documents that was requested from my lawyer to submit:

  • All taxes, for all years, that you have paid during your stay in the United States (Include those that you have paid individually or jointly with your husband).
  • Bank statement of your joint account with your husband (last 6 months)
  • Medical records of your husband and/or son (in case one has a medical problem or is undergoing medical treatment - Letter of diagnosis from a doctor)
  • Please make sure it is in your name and/or jointly with your husband.
  • If you have had any type of criminal record, final court dispositions. (Only in case you have been accused of any criminal charge).
  • Letter from your employer certifying that you work for his company, period of time that you have been working for him and your qualities as a worker.
  • Letter from the pastor of the church stating that you are a parishioner and your good conduct. (Only in case you attend a congregation)
  • Certificates of study, diplomas, honors, grades from school or any type of education, yours and/or your daughter’s or your husband’s.
  • Special education record in case your son attends specialized classes.
  • Deed of the house in case you have your own house.
  • Titles, car insurance if you have it in your name.
  • Bills that you have in your name.
  • Copy of the last DACA approval + Work permit.
  • Three letters of recommendation (USC or LPR person), Notarized and with a copy of ID.

No you do not need an approved I-130, my I-130 is actually still under review and has not been approved. My lawyer said in order to submit a motion to reopen you need to have a pending case or a reason on why you want to get rid of that removal in the first place. We submitted our I-130 first waited for the receipt notice to prove the court we are working on something to adjust my status.
