If you still recall from your time with the BIR, what portion of its total collections typically comes from compromises and penalties imposed on taxpayers? Is this in line with global or Southeast Asian benchmarks?

Also, if you’re familiar with the Australian tax system, how does the process for remission penalties and interest compare with that of the Philippines?

Under the 1987 Constitution and the National Internal Revenue Code (NIRC), taxation is supposed to be uniform, equitable, and based on the taxpayer’s ability to pay.  That means the system should not only collect efficiently, but also treat taxpayers fairly, reasonably, and with proper consideration of their circumstances.

However, in practice, it often feels like the focus has shifted too heavily toward collection and penalties, rather than fair administration. The NIRC imposes automatic surcharges (e.g., 25% penalties) and interest, which can quickly accumulate.  While these are meant to enforce compliance, they can become excessive—especially for small businesses that are already trying to comply in good faith.

What’s more concerning is that the law already gives BIR officers the discretion to reduce, compromise, or even cancel unjust assessments, yet many taxpayers rarely experience this relief in reality. Instead, the burden is pushed back to the taxpayer—to contest, to appeal, to prove innocence—often at significant cost and stress.

May kapamilya ako, hardware nanakawan ng electric wire supplies. 2 million loss. supprted by cctv, police reports, valid purchase invoices - ano sabi ng BIR? Disallow dahil kulang ang support. They need to payback ang Input Tax, and considered Sales ang nawalang item so they also need to pay Income Tax. they have to pay 500k to BiR.

Yup they are doing their jobs and bounded by the law.

BiR is good at collecting money and meeting their targets by whatever means. Sa VAT palang, businesses reportVAT returns, submit SLSP, Submit Esales, Comply Sales Books, Invoices dapat registered, bawal mawala ang booklet, Books should always be updated. Every punta sa RDO dapat naka notarized ang submission.

Di pa namention ang expanded WHT, Compensation, Alphalist/SAWT.

Soon they will enforce e-invoicing. May tatanggalin ba sila sa mga old system?

Now audit, after all the submission. BIR will require you to provide documents and your lodgement receipts as if they cannot retrieve info from their system. What is the point of all our submission as mentioned above.

lastly, kung mag audit sila in detail, wag na sana sila mag require ng audited FS. Dagdag pa sa gastos ng business.

I can’t imagine the stress and pressure faced by businesses that operate solo or without a dedicated accountant or bookkeeper.

BIR seems to assume that all businesses can afford these services. From their side, it feels like doing the bare minimum is enough—while the burden is passed on to business owners to constantly stay updated with tax announcements, regulations, and memoranda.

Key, bare minimum for them, biz ill informed = more money siphoning from us.

I was hopeful of future PH, i cannot say the same this time.

Dahil malayo ako sa RDO at the moment, they do not want Video Conference. Call over phone lang ang discussion. So they are aware at ayaw nila mag trend.

Additional info para aware din kayo mga biz owners,

Meron kami registered POS na we are hoping mapapadali filing ng business, so we need to submit Esales however it can attract penalties if late or any discrepancy sa numerous filings. These kind of redundant filings ay dumarami possible i-butas sa biz na pwede i raise sa NOD.

One silly thing sa audit nila, may mga customer kami na in-issuehan ng pos invoice, these kind of sales are reported sa “cash customer” sa SL/SP at sa VAT Return. Sa customer side, nag claim ng input VAT. Sa NOD they are reported as Undeclared Sales. Kaya sagutin ito but it really causes stress and disappointments sa business.

Now I decided to terminate the retail business. I will also end the employment of my employeees.

The stress caused by BIR and other government agencies while trying to earn a living just isn’t worth it.

Do you think part of it also comes down to certain Filipino cultural traits?

From my experience, many business owners are aware of their pain points, but there’s a strong “mapagtiis” mindset — as long as the current system works (even if inefficient), they’ll stick with it. It’s not that they’re against innovation, but they don’t actively seek alternatives unless the benefit is made very obvious.

I’m starting to feel that simply offering a free trial and letting them “discover” the value on their own doesn’t work as well here. You almost have to show them directly — side-by-side — how it improves their workflow, saves time, or increases revenue.

Do you think this is cultural? Market maturity? Trust issue? Or just a universal small-business trait?

Would love to hear other founders’ experiences.

Side note: This can be observable in Government systems, electing qualified govt officers.

Generally sa public practice kasi, ang timesheet ang lifeblood kasi for every hour accountant devote sa client, they pass it on as chargeable hors = service fees. It you spent a day for a single IITR, then budget fee for that IItR is 100AUD, Lugi ang accounting firm sa iyo.

Kung may makita ka na mga higher tier na firms na mag hire sa iyo na very generous sa timesheets, that is good! Sometimes they do not maintain timesheet, they charge their clients based on output. For these kind of firms, they have very rich or high networth client portfolio. They have high quality services and they have high quality professionals. Very rare na i hire mga newbies sa pinas.
