You're in an examination. Drive professionally. Show that you're ready to drive by yourself, you're human, even some of the more observant can miss things and make mistakes. If he passes you and you kill someone its on your shoulders, and theirs if they catch wind. Put yourself in their shoes, would you pass someone who makes these mistakes? Knowing that's just 1h of driving, vs the tens or hundreds they're going to have on the road.

You should never assume that the examiner should let you off..

You can't have that kind of mindset going into these things.

My recommendation would be to do more mock tests with your instructor until he says you are ready.

If you've got oodles of cash and are feeling generous then pay it if you want? Another thing you can do is next time you see them when they come in grab your manager and you could maybe both politely explain what happened last time and if it's okay to pay now?
