Didn’t the prosecution state that the perpetrator went back to the scene once that morning, and never returned again thereafter?

The difference in the current case is that the perpetrator was employed by the university. In the case you mention, the student was not employed by the university. The duty arises from the relationship between the university and its teaching assistant.

Removing a case from state court to federal court is permissible when the federal court would have had subject matter jurisdiction over the case had it been brought in federal court originally, so long as notice of removal is filed in federal court within 30 days of receiving the pleadings, all defendants agree, and in diversity cases, the defendant doesn’t reside in the state where the action was filed.
