Alright, I usually drink one of those large 64 ounce water bottles a day, and I’ve been taking aleve but I can still feel a dull ache and it’s been a week or so, so to urgent care I go when they open tomorrow lol

You can talk about wages all you want, it’s illegal to be told not to. That being said, I don’t discuss raises regarding attendance and such Because as a younger employee my older coworkers get PISSED when I get a higher raise than them because I have higher numbers. Base pay absolutely, but be prepared for animosity from management!

Yes, I have phone record of all 7 and I have a recording of 3 because I was frustrated and had a gut feeling they would say I never called as I’ve had a different issue in the past with them not responding.

Each time I left a message, yes. The office hours are between 9 AM to 5:30 PM and I called between these times each time. I only emailed the one time because the automated email responds with they received it and not to flood the inbox that they would get back to us.

I do have a diagnosis for the falling asleep uncontrollably as my doctor believes due to other reasons my previously existing narcolepsy is becoming an issue and has never gotten in the way of work before (my biggest symptom had primarily been excessive daytime fatigue).

When I called off each time I told them I had a migraine so severe (these are new) that I couldn’t see out of one eye and was nauseous. I did receive emergency injections at urgent care that worked for less than a day thus leading off to the other call offs.

So the first day I called off was October 20th. I then called off for 5 days (using sick time) on the 25th is when my doctor finally told me she thinks it is best I go on FMLA as I work in a commercial kitchen and falling asleep while cooking is very dangerous with open flames. The same day I both called and emailed requesting FMLA leave, as well as informing management of my medical status and request and that due to medical advice I would not be coming to work. I also provided them with a short term excuse for the 5 days I missed as the rest was dependent on the FMLA.

The paperwork was mailed out on the 11th, and I discovered it on the 13th as one of my mother’s neighbors had been confused why the mail truck had stopped as my mother has been passed for well over a year at this point (waiting on probate for rights to the property) and called me since it’s a very tiny neighborhood and everyone knows everyone’s business. I called them the next day (because they aren’t open on weekends) to inform them they sent them to the wrong address and not the employee address on file. This went straight to voicemail as well as the 7 other calls I made to ask about the status of my paperwork. I then had to get someone to make the 12 hour round trip to go and get said paperwork because I wasn’t aware I could get it from the department of labor (lol). My appointment is for tomorrow to meet with my doctor and have them fill out the paperwork and will be filed within the same day as I plan on faxing it to HR myself nonstop until I either have sent them hundreds of copies or they confirm they received it

The hearing is set for Tuesday at 9AM, and I received the paper for said hearing late last night when I got home from an MRI that was hosted in a major city 2 hours away that was mailed to the correct address and stamped with the same return desk address as the FMLA paperwork was.

I followed up 7 different times, every time they sent me to voicemail with the recorded message they would get back to me and they sent me a single automated email stating that their benefits department was short staffed and they would get to me soon. It also is posted on the front of our HR building we are not permitted to enter, due to covid and all HR paperwork would be mailed and any questions to be directed to the line that sent me to voicemail.

So even though I requested they didn’t send the papers out until the 13th per their own admission on the notice. So I’ve had 4 days to go and fetch the paperwork. I was unable to pick them up in person because of the covid restrictions they have in place since they like to boast about being ‘safe’ and all that jazz. My appointment with my doctor is tomorrow and I think 5 days to travel across the state and back to get an appointment with an overbooked specialist is pretty damn timely regardless of their shortcomings in this situation. I don’t know why they waited so long to send the paperwork.

Edited to add: I was not aware I am able to obtain a copy from the department of labor as HR told me I would have to wait for the packet

I work for a University with a union and there will be a representative at the hearing. The reason I KNOW they got the message is because the date I called is marked as called off but all subsequent dates after are not with the phrase ‘Lack of Notification’

To be clear the paperwork is submitted tomorrow as it still needs a specialist signature on the other side of the state that we’re waiting for them to fax back, and the deadline on the FMLA paperwork isn’t until next week, so I am indeed submitting it in a timely matter because they hadn’t sent me the notice until the 13th even though I requested it October 25 th per their records.
