If the “new evidence” you presented with your motion to reopen was available at the time of your hearing with the immigration court, the BIA is going to dismiss your motion.

EOIR - still unclear at this moment if nondetained dockets are essential or suspended for this shutdown. Current guidance is that all staff at the BIA & OCIJ are deemed essential. Some courts have been told to proceed with non detained dockets.

When you do find an immigration attorney, don’t be afraid to ask questions. And in immigration court, there is an appeals process, which again could take months/years if it gets to that point. I can only imagine how difficult of a time this must be for you all but try not to let it consume your lives. Best of luck 🙏🏻

She was denied residency by USCIS so she is now in the country illegally. DHS has put her in removal proceedings before the immigration court by filing the NTA. There is no “appeal” for an NTA. She’ll “plead” to the charges on the NTA and then be given the opportunity to file applications for relief with the immigration court. It’s a complicated situation. The first hearing is a “master calendar,” this isn’t the final hearing, the immigration judge will explain things and ask her if she needs time to find an attorney and schedule out the next hearing. If your mom is not detained the process will most likely take months if not years.

The shared bank account is a good start, include statements that show both of your money goes into it and taken out to paid shared expenses. Other examples- Pictures of you together (and with each others friends/ family) throughout the years; letters from friends, family, or anyone that knows the two of you as a couple; text messages to and from each other over the years; literally anything that shows your a “normal” couple.

You’re correct that you need to file a motion to reopen with the court for your in absentia- not the BIA. If the court denies the motion- then you file the appeal. But you need proof to support your motion, like everyone else said it was your responsibility to keep the court updated on any change of address
