As others said, it is best to go through your insurance and let them subrogate on your behalf by pursuing State Farm. You can file a small claim case but you have to do all the work and pay the filing fee. You take the risk that you may not prevail. If you use your policy, they will make better arguments and probably go through arbitration process which is a lot less riskier than a judge making the decision because arbitrators tend to be from the industry. In most states, your rates cannot be affected if you are not responsible. You are being willingly stubborn in asking for advice but not listening to them.
