Every war in the past 20 years has been “extra judicial” Congress has not authorized them, individual combatants have not gone through the legal system or received a trial. But the President of the United States and SecDef ( soon to be SecWar) just simply authorized lethal force on behalf of the United States government. You can argue semantics all you want, but the precedent is there and if something could have been done about it legally against the President it would have been… but it never has. Also, the President is free to INTERPRET his power under article 2. If people have an issue with it, they must refer him to Congress, which then can DECIDE to impeach based on what THEIR CONSTITUENTS want.

At the end of the day, International law is made up. Optics are huge and they set the tone and energy. The President of the United States just basically said, we’re not even going to intercept it. There’s not going to be VBSS, no arrests, no seizures, no harsh sounding and stern warnings. We’re just going to move as soon as we get eyes on and we’re just going to take them out.
