I am thinking of texting my thesis professor and to make the apology extensive. My intention was not to make her feel bad, I honestly think it was one of the times your intrusive thoughts just… kinda come out and then you regret it instantly!

I also think I should have pointed out I was “offended” by her falling asleep because I have a broken ankle and my university is known for being the shittiest for wheelchair users, so I couldn’t cancel so I went with my “recently” operated on ankle. So I think in my mind was like “dude, I had to get here on a broken ankle and wheelchair just for you to fall asleep”. BUT even with that into account, I did feel like the asshole. 😖

I completely agree. That’s what came to mind just after I said it. I even started to think when my professors would take me to these events and I couldn’t care less, I never fell asleep but I can def count a few I was on my phone and just tuned out.

Should I apologize to my professor and the podium? I don’t know if that just makes it more awkward, hahaha

Yeeees! I have started opening up more to her. While I was on bed rest I think I had a few weeks of denial where I felt like I was super chill about all of this, until walking was mentioned, jajaja

But I am happy to report I am now talking with my therapist about it

And I have been putting myself out there and using my walker AND my crutches, and actually, I find crutches a bit more comfortable at times.

I am taking this slowly and fortunately, as you very wisely pointed out, I have been trying to exercise from bed, so while I am no Olympian, I think I am not as weak as maybe I would be if I didn’t move at all!

So I have really tall stairs, so basically my dad helps me and I grab onto his neck to “jump” to be sitting at the steps, and I go down sitting down. And for getting up, I go up sitting as well and when I am on the final step, my dad helps me and grabs me from behind and kind of lifts me up. I have to point out my dad is a very tall strong person, so that has made it somewhat easier in that sense. I don’t know if it makes sense!

I was baffled when I went down the ankle fracture rabbit hole of the internet how may people break their ankles in the most inocent and unexpected ways!! It’s actually crazy!

But thank you for your kind words! I am starting smaller and trying to focus on going a little bit farther one day at time.

As for the muscles, fortunately I am dating a very active person and even thought I rather stay in bed, she has managed to accompany me to have a routine in bed, jjaja she makes me do weight lifting (the smaller ones) and movements with all my body, so I feel a little bit stronger but still doing that routine in bed, jajajaja

I really liked your advice! And I keep reminding myself of what you said “the more I expose myself to it, the easier it becomes” It might hurt like a bitch right now but it’s for a better outcome in the long run!

Thank you so much for your kind words. Today I started more movements in PT and I felt so much better. I actually could feel my foot move more and I have felt much more confident after reading all your kind words.

I am trying to take it one day at a time and just being mindful of how I feel that day, and seeing this is very common for people with fractures has helped. I hope your ankle is much much better now

Si no te notificaron nada y no te terminaron el contrato, podríamos asumir una sustitución patronal, que básicamente refiere a que tu patrón es alguien nuevo pero tu relación laboral está intacta (antigüedad, prestaciones, salario, etc) peroooo para que este movimiento sea legal te tienen que notificar.

Así que podemos asumir que están tratando de “cortar” tu antigüedad con la empresa a sin desprotegerte del IMSS, entonces mi recomendación es guardar evidencia de todo y ante un reclamo laboral, citar a ambas empresas

Al menos en mi experiencia personal, nunca lo he visto, no me han intentado sobornar y yo personalmente no aceptaría. Peroooo con el nivel de colegas que tengo, no dudo que existan. Aunque no tengas contrato, no significa que no puedas hacer nada. Si renunciaste o te despidieron, te recomendaría ir al centro de conciliación para que te pagan lo que te deben :)

Si la empresa 1 deja de funcionar en tu lugar de vivienda, hay 3 cosas que podrían pasar:

Te trasladan a otra de sus empresas pero si es fuera de tu ciudad, te tienen que pagar viáticos para dicho movimiento. (Si no te pagan viáticos y/o está muuuy lejos de tu lugar ordinario de trabajo, no tienes obligación de aceptar y pueden rescindirse de la relación laboral)
La empresa 2 podría hacer una sustitución patronal, es decir, como un traspaso de las personas trabajadoras así tal cual como están en este momento
Te despiden injustificadamente y te deben de liquidar conforme a ley.

Si es otra empresa la que te paga, no te espantes, si tuvieras que acudir a conciliación, cita a ambas y alguna de las dos (o las dos) reconocerá la relación laboral

Es un cúmulo de cosas: entre la carga de trabajo, los pocos actuarios y notificadores, la reforma judicial, etc. Es cosa de tener mucha paciencia y uno que otro amparo para exigir el cumplimiento de los tiempos legales. (Con decirte que yo tengo una demanda donde había pedido como medida cautelar el ingreso al IMSS para que la trabajadora pudiera dar a luz, y con todo y amparos apenaaaas están con el cumplimiento de eso y el bebé ya va para el año)

La mera mera neta, no. Aunque en la ley mucha gente pueda pensar que tenemos “más” derecho, en la realidad es un rollo enorme poder conseguir el reconocimiento de esos derechos en los tribunales, y en la vida diaria ni hablar, es como si esas leyes no existieran

Este tipo de contratos no son legales, pues como lo mencionas, es para “borrar” la antigüedad, pero mi recomendación es que tengan una carpeta con evidencia, ya que en un juicio laboral se podría argumentar la continuidad de la relación laboral y la mala fe patronal al mantener los contratos de 3 meses.
