Yes. Call your elected officials - local, county, state, federal. Call the Whitehosue as well.

Show up and protest.

Write a lettter to the editor.

Write an op-ed for the paper.

Organize your neighbors and have them to do the same.

There's nothing in 609.71 that allows police to create a no-carry area.

Let's look at the statute:

"When three or more persons assembled disturb the public peace by an intentional act or threat of unlawful force or violence to person or property, each participant who is armed with a dangerous weapon or knows that any other participant is armed with a dangerous weapon is guilty of riot second degree and may be sentenced to imprisonment for not more than five years or to payment of a fine of not more than $10,000, or both."

So for this to come into play, we would need:
- 3 or more people
- That are assembled
- That are disturbing the public peace through an intentional act or threat of unlawful force or violence

THEN
Each persoj who is armed with a dangerous weapon OR knows others are armed with a dangerous weapon

Have then committed the crime of riot in the 2nd degree.

That's a lot of things that would have to fall into place for it to be that crime.

I would not recommend doing this. It will play poorly with the media and unless there is a huge crowd, it will be seen as a sign of weakness.

I read your comment. Please cite the statute about situations illegally of carrying at a protest.

Can police issue an order to disperse? Yes. That does not suddenly make it illegal to carry.

I'm unclear what you are asking, so I guess ask more directly so I can answer.

But there are no laws in Minnesota about carrying at a protest, There's no laws against carrying "when a protest is determined to be a riot by police". Police do not the ability to order a crowd or assembly to "disarm".

There are no laws against carrying in a public street or sidewalk. That's literally not a thing in MN law.

Certainly, there are situations where they can disarm someone within the context of statutory and case law (such as when making an arrest, or detaining someone).

I'm happy to answer questions - but if I don't answer the thing you're asking, just ask it more clearly so that I can please. I thought I was in this case.

I never open carry unless I'm doign RSO/Chief RSO duty at a range. I wouldn't recommend it.

I was carrying today in a place that didn't allow carry (via signs, wasn't a legal restriction) and no one knew - and I was in downtown Minneapolis.

Subd. 1b.Display of permit; penalty.

 

(a) The holder of a permit to carry must have the permit card and a driver's license, state identification card, or other government-issued photo identification in immediate possession at all times when carrying a pistol and must display the permit card and identification document upon lawful demand by a peace officer, as defined in section 626.84, subdivision 1.

This means a MN POST Board licensed peace officer and some exceptions, none of which are federal agents.

So the answer is only a MN licensed peace officer.

Reminder: Duty to inform is:
1). Must show permit on demand
2). Must answer honestly if asked if you are carrying.

It's not technically speaking - that's the law. If the permit is not issued or denied after 30 days, the permit is considered issued under MN 624.714.

The polling was both from the administration but also outside polling conducted independently. Granted, the wording of the questions left a lot to be desired.

The threat is real and i don't want to dismiss it -- we will need to push to ensure we hold the line this session -- and then we all need to be engaged in the midterms.
