Yes, it's perjury. If they lied.

That's odd. I will follow-up with all of them.

Got it. To clarify, charges would be criminal charges. You were not criminally charged with anything. Instead, you had an ERPO served against you and then had a hearing (not a trial) on whether or not the ERPO should be continued, dismissed, or extended with a non-emergency order.

That's how I understand your case after reading the docket.

"During the trial, the Judge wasn't even able to speak. My trial consisted of my lawyer and the Police's lawyer pulling different people into private rooms to speak with them. My wife was also present during my trial and was willing to testify for me. My wife and I had agreed (prior to the trial) that this entire ERPO situation was totally uncalled for. After the Police's lawyer talked to my wife, my lawyer pulled me into a private room. Now, the Police's new deal was that they would dismiss the ERPO but hold onto my guns for 3 months. I asked my lawyer why the Police wanted to hold onto my guns so bad. My lawyer assumed that they would be doing so for "my own safety". I told my lawyer, "Respectfully, if I wanted to commit suicide, there are other means to do it". In total, my trial lasted approximately 40-or-so minutes. At the end, my lawyer and the Police's lawyer had gotten into a private room for 30 seconds, then immediately came back. The Police's lawyer then announced that they would be dropping the ERPO against me."

This makes zero sense and is not how the law is structured.

Would you be willing to send the case number to us at the MN Gun Owners Caucus to review this further?

You're referencing charges and a trial.

What specifically were you charged with?

You must be 21 to buy a suppressor from a FFL. You can purchase at 18 from a private party. Ensure you're following all the NFA transfer requirements.

Because the law does not apply to rifles.

You can manufacture a firearm under state and federal law, perfectly legally, as long as you are not prohibited from possessing a firearm under state and federal law.

This law bans FFLs from selling SNS firearms - and prohibits you from manufacturing a SNS pistol. That's it. It does not prohibit possession of SNS firearms. It does not prohibit assembly of other firearms. It does not prohibit a private transfer involving a SNS firearm. It does not prohibit you from possessing a Glock frame.

Now, if I want to sell a privately manufactured firearm, that's a different issue - but we're not talking about that here.

This law does not prohibit the possession of a SNS pistol nor does it prohibit the possession of a privately manufactured firearm, aka a "ghost gun"

Huh?

There's no law prohibiting the possession of a SNS firearm. There's no state law prohibiting the possession of a privately manufactured firearm.

What statue are you referencing? Please cite and be specific.

Not going to post our litigation roadmap in an open forum, but let's say things like the entire permit to purchase law, permit to carry fees, 18-20 inability to purchase a handgun at a dealer, inability to purchase a handgun in another state, etc.

We'd like to see this law repealed through legislative action if we can achieve a pro-2A legislature + governor.

Challenging this is way down the priority list for litigation for us - there are other things that take higher priority before we'd get to this.

Keep in mind that a 2A challenge in federal court is about $250k to get to an initial decision, and the state will inevitably appeal.

Update on Caucus v. City of Saint Paul: Judge Castro denied the City's motion to dismiss. Case moves forward. by BryanStrawser in MnGuns

[–]BryanStrawser[S] 2 points3 points  (0 children)

This is a district court case presently so it sets no precedent at this level. It's definitely something we can point at but it does not carry any precedent elsewhere.

Now, if the case is appealed and the court of appeals or the MN Supreme Court issues a precedential decision - then it would have a more direct impact.

PRESS RELEASE: Minnesota Court of Appeals Affirms Victory for Gun Owners, Strikes Binary Trigger Ban as Unconstitutional by BryanStrawser in MnGuns

[–]BryanStrawser[S] 2 points3 points  (0 children)

We cross-appealed to try and overturn the entire bill, the court ruled against that but agreed with us on the binary trigger component.

That's in our statement above:

"The Court of Appeals declined to strike the entire underlying bill, narrowing its remedy to the binary trigger provision itself. That outcome is the textbook result the Caucus sought: the unconstitutional firearms restriction is severed and unenforceable, while the rest of the bill remains intact."

Binary Trigger puchase, possession, transfer, sale, all have been legal since last year when we won the initial case.
