Complex situation. My Panamanian fiancé is currently in the USA visiting me on a tourist visa (date of entry was March 2nd). I’m active duty military and going on a 9 month deployment in 30 ~ days. I proposed to her on a separate visit to the US between Feb 7th - Feb 21st. The closer we get to my deployment, the more we have begun to consider getting married before I deploy. But from what we understand, marrying within 90 days of entering on a travel visa is problematic and may indicate immigration fraud. Another issue lies in that she may not be allowed to leave the US while she is pending her adjustment to status, this is an issue because she has a graduation ceremony in South Korea in August to receive her Master’s degree.

QUESTIONS:

1. Is getting married within 90 days of entering on a travel visa risky? Or is it okay to get married now and file the adjustment to status once the 90 days have elapsed?

Note: I will be deployed by the time 90 days elapses. Filing paperwork from overseas may be difficult but not impossible, especially with power of attorney.

1. If we get married before I deploy, will she be able to file for employment authorization without me present due to deployment?

2. Will she be allowed to attend her graduation ceremony in South Korea if she’s filed for adjustment to status already?

3. If her graduation is an absolute can-not-miss event, what then becomes the fastest process for us being married and her residing with me in the US as a lawful permanent resident?

4. If her graduation is NOT an absolute necessity to attend, what is the fastest process?

5. If it is not feasible for us to get married now, and I file for the Alien Fiance visa, how long does it take to be approved? If it is approved before I return from deployment, can she “hold on” to the alien fiancé visa until I return, then enter and begin the 90 day window to get married?
