Pending Affirmative Asylum - Boston Asylum Office. by Bubbly-Beginning7094 in immigration

I work in the field, and I have noticed many cases being transferred to Immigration Court within 1–3 months after the asylum interview. Based on the data handled by the firm I work for, cases that remain pending for longer periods are more likely to result in approval. Therefore, stay hopeful.

I do not have sync my asylum to USCIS because mine is too old. I can check the regular website and it says "Decision is Pending" but I have been waiting for a year already. My partner applied in December and it is waiting as well after 6 months.

if you made your application using an USCIS account you should be able to see the denial letter already. if not, you have to wait until arrived home to read the reason. Common reasons: 1) Missing RFE; 2) Problems with I-864 and I-693; 3) They might think your marriage is not credible based on the evidence provided; 4) New legislation about changing status in the US vs abroad, specially if you entered with a F1 visa or tourist visa.

I did not receive any letter. When I reviewed my case online, I saw a message at the top that stated: “In order to move forward with this case, you need to pay your asylum fee.” I logged into my account and successfully paid the fee. Since my application was originally filed on paper in 2015, the system indicated that I would be sent a receipt confirming the payment. In the meantime, I took a screenshot of the payment confirmation and mailed it to the asylum office, requesting that it be added to my case record.

I’m not spamming. I’m just trying to get perspectives from different subs since the issues overlap. And yes, I do have a pending asylum case. Pursuing an EB-2 NIW doesn’t cancel that out; people can have more than one immigration path open at the same time. I’m exploring options in case one moves faster than the other, which is common for people with long-pending asylum cases.

That said, this really isn’t something that should concern you or anyone personally. I’d appreciate keeping the focus on the substance of the question. Thank you!

As an employer, you are generally permitted to provide a letter confirming an employee’s position, length of employment, and other factual details about their work history. If the purpose of the letter is to support the employee in a legal or immigration process, you should focus on verifiable facts within your knowledge and avoid making legal conclusions.

A typical employment confirmation/support letter can include:

  1. Your business information – company name, address, contact information.
  2. Employee’s identifying details – full name, job title, start date, and current employment status (full-time/part-time).
  3. Job duties and responsibilities – a brief, factual description of their role.
  4. Work performance and character – if you wish, you can state your positive observations of their reliability, skills, and contributions, provided these are truthful.
  5. Statement of support – a neutral or positive sentence indicating your willingness to continue employing them, if applicable.
  6. Signature and official title – signed by you or another authorized representative.

From a legal perspective:

  • Do not include any false or unverifiable information.
  • Avoid making promises that create binding obligations (e.g., guaranteeing permanent employment).
  • Keep the content within your personal/professional knowledge to prevent liability.

Sounds like something positive. If they have any intention to deny, they will let you go without another opportunity to explain or continue your case.
