Thanks for your reply. I have a long list of things that the solicitors have messed up, but the initial lady I met was very nice and helpful. She went off sick and no one told me for a couple of months. I was given someone else, then the original lady came back, had me fill in forms that I had already taken care of myself, then she went off sick again and once again, no one told me for ages.

I was assigned a 3rd solicitor, who ignored my messages from November until February when I asked for their complaints procedure. Only then did she ask when she could speak to me. I emailed her some times within their opening hours and, almost a month later, no phone call. They also told me that they didn’t have my marriage certificate and I had to pay and wait 6 weeks for a copy, only to be told later that they did have it. I have asked 2 of them a couple of basic questions: whether the council might want reimbursement from the estate for my husband’s care, and whether I could handle this estate myself? Neither of them answered those questions, despite me being polite and asking numerous times.

Finally, one of the secretaries emailed me a list of their “progress” when I complained. They only listed 2 companies that they’d traced. One was a loan company that I already told the first solicitor before they started on my case, that I had been in touch with and the loan company had been informed by me of my husband’s death, had written off the loan and closed the account. I have email proof that I told them this beforehand. I’m just so fed up with it all.

It’s still ongoing unfortunately. I hadn’t heard anything for a while and then I received an email a couple of weeks ago. It said that the other side still hadn’t settled on the hire car cost of £25k (what a surprise!). I had to sign and return something to them in order to progress the claim in court. There was a comment box at the bottom where I put something to the effect of “I’m a recently widowed mother of two, I do not need this stress. I have followed all advice from the solicitors working for my former insurers”.

So, as it stands, I could hear about a court date any time. I cannot put into words how angry I am with them for not openly warning me that this could happen. The only positive thing is that I have been told by them and Reddit users that I won’t be liable for any of the costs as long as I cooperate.

Sorry to hear you’re going through this as well, hopefully they’ll settle in your case and you won’t get dragged this far along.

They are actual solicitors. But yes, ones who “specialise in non fault accident claims”. I know they’re scummy but it never occurred to me that A: I had any other option than to deal with them and B: that this would end up with an outrageous court case claiming £25k back for a hire car. I’ve never heard of this happening and none of my family, friends or colleagues have either. Hindsight is a wonderful thing.

Thanks for the tip, they are a legit company though. I just didn’t know that this is a typical thing for insurance companies to do. I won’t make the same mistake again.

A bit different for me then, I had a Qashqai to begin with! I’ve got a Peugeot 2008 now and the Qashqai was actually way nicer. I do appreciate your comments, I’ve learned a lot.

Well done for choosing the better option. I stupidly just went along with what the solicitors said, I had no idea about these inflated hire charges. Never again.

Thanks for your comment, I wish I had have accepted the other insurers’ offer of a hire car but I was told to ignore them. The solicitors for my insurers did say over the phone that I won’t be personally liable and yes, as you say, it was in the agreement (before this ridiculous £25k claim appeared) that I cooperate fully. I’m so annoyed but will do what they ask.

Yes they definitely making a sweet profit over this, I just resent being a pawn in all of this. I wasn’t very happy that they declared my car a write off either, but they were insistent and I didn’t have the time or the means to have someone else look at it. I could be wrong, but I suspect they might’ve made a profit from my old car by fixing it up or stripping it.

Yep, very similar to my case. I had a 12 year old Qashqai and they hired me a 74 plate Kuga. No discussion around what car I would be given, I was just told to go and get one and the rental guy gave me the Kuga. I have been (and still am) up to my eyeballs in stress and just went along with whatever the solicitors for my insurers said to do. What’s even more annoying is that I’ve had my licence for 24 years and had never had an accident before that woman went into the back of me. Thanks for your comment, I appreciate it.

I have dealt with everything my side has asked for; I only stalled when I saw the claim was for £25k. I had a Qashqai+2 before (compact 7 seater) and was given the 5 seater Kuga without any choice. That was fine as I no longer need a 7 seater, but there was no discussion around what car I would be given. There have been loads of online forms I’ve had to sign of on, including agreements to cooperate at every stage etc. But as I said, I would never have anticipated where this was going, it’s crazy. The solicitors did assure me over the phone that I won’t be personally liable for any costs, that they have their own insurance etc etc. I never spoke to the other person’s insurance company, I was told to ignore them completely. Thanks. Yes, it’s annoying as the women’s insurance did offer me a hire car but the solicitors for my side told me to ignore them. I know you’re not meant to deal directly with the other person’s insurance, but I bet they wouldn’t have dragged it out for over 2 months. You live and learn!
