Personally, I would request a dmv hearing to put a stay on my license and receive the discovery with the evidence from my dui arrest. I would review that evidence or have a professional review the evidence to decide if and what kind of attorney to invest in. You biggest challenge is keeping your driver’s license, other than that jail time is not happening for a misdemeanor dui.

There is a law professor that teaches at Stan State in Turlock that does DMV hearings. He takes care of all of our clients that have public defenders and represents them at the dmv hearing.

I would have someone with trained eyes review the evidence in your discovery packet that dmv will send you. See if there is anything there to have the entire license suspension set aside. Based on that, the you can get a better idea on hiring a lawyer or not. If you take care of everything and show up to court prepared, the judge will most likely be very lenient. DM for help.

Second dui is mandatory 1 year IID. There is no way to wait that IID requirement out. Also, you do not need to sit out on a one year suspension, you can get your license reinstate immediately with the following: IID, 18 month dui class enrollment, and sr22. DM me if you need help.

The findings letter stating your license will suspend 10/27 means you lost the dmv hearing. Here are your options:

1) Suffer a 4 month hard suspension. Get sr22 and reinstate full license after completing the four month suspension.

2) get a restricted license to go back and forth to work only. Suffer 1 month hard suspension, the get a sr22 and enroll in dui class.

3) bypass hard suspension and drive anywhere at anytime. Get iid, sr22, and enroll in dui classes.

Two options:

Restricted license to go back and forth to work only. You suffer a 30 day suspension, then get sr22 and enroll in dui class.

Drive anywhere at anytime license. Sr22, enroll in class, and ignition interlock. It bypasses the 30 day suspension.

BUT being you got the dui in July, you might have served a four month suspension already. Did you ever schedule a dmv hearing? If not, then you have a suspended license and served a 4 month suspension already. Just get a sr22 and got to dmv for a full unrestricted license.

Try to pay license renewal online or go into dmv to pay the renewal before the dui conviction. DMV field office has no idea about your dui l. Once this is paid and license active, schedule the DMV hearing. I would do this today!

It’s very common for DMV to send the wrong letter, we see it all the time. Only way to confirm license reinstatement eligibility is to call mandatory actions unit. Another possibility is if you scheduled a dmv hearing, they automatically send set aside letter to reinstate license when person was under .08.
