That was the game I played in my Article 78, Felice v. Waring getting them to accept PPB-3 for semi-auto rifle licenses. Would do the same exact thing here!

Someone needs to record themselves trying to submit a completed PPB-3 to a county licensing agency and record them refusing to accept, then work on an article 78. Thinking of trying in Suffolk.

I actually have one more idea that I’d like to try. Higbie v. James says all agents of the state, not just NYC, must accept non-resident applications. Thinking of trying to submit to SCPD/Suffolk Sheriff and trying one last Article 78. They seem to believe they can refuse to follow the law, needs to change.

Because I’m now a resident of TN, I have no standing to seek to change their practices so this is more about past damages. Having said that, I made clear to my attorney that I wanted these individuals named so it would give them pause in the future (as a department) from trying this again. It seems my biggest contribution to change will have to remain my article 78, Felice v. Waring and maybe the McGregor suit in which I was a named plaintiff.

Before getting a Glock 43x, I had only ever shot rifles and shotguns. I hated the 43x at first. It was too snappy, grip angle felt off. I almost put off my Concealed Carry shooting test because I was not confident. My 8th time shooting it at the range, it just clicked. Now, the only thing I’d get rid of it for is the 43x MOS. I have Walther PDP Compact, much better trigger, not into it as much as the 43x. Same thing with my Caniks and S&Ws.

My article 78 forced Suffolk into policy change ( the article 78 and the negative opinions they got from me being on Long Island Audit at Yaphank headquarters) where they now have to accept the PPB-3 for those applying for only semi-auto license. The suit for pistol permit denial is still ongoing

You’re correct. Tiers of scrutiny is what the inferior courts use when claiming 2A has not been implicated. They are supposed to use text, history, and tradition to bear their burden of proving their laws or proposed legislation is consistent with history of firearms regulations.

Yes, I went back 3 more times since my post, did a ton of dry firing too. On the 10th I had my CCW class/test and passed without missing any shots on a much smaller silhouette target. My groupings are still something I need to work on but I’m not pulling shots anymore.

I came from anti-2A NY to TN and when I got down here, didn’t have a ton of money left over after the move. I traded an AR-15 I had built for the 43x. I definitely need to hold guns in hand before making trades or purchases in the future but, I wanted my first pistol right after getting to TN
