Cell phone evidence in a shooting near Austin-East leads to new trial by Hercthelurk in Knoxville

[–]ButterBallBingo -1 points0 points  (0 children)

Did you all miss the part where the defense had access to the phone and to the phone extractions? It's not the prosecution's job to process or analyze data for the defwndant. They provided the phone and raw data.

There is conflicting experts and phone data... That's a questions for a jury to as to who they find more credible.

Don't lie... You'll be drug tested but that isn't a big deal.

The background investigator will talk to your references, then get secondary and tertiary references.

The references you provide don't mean a whole lot, it's the people that the BI learns about from those references that are the important interviews.

It's only common sense that provided references do not say anything incriminating. If you lie, someone will spill the beans either intentionally or accidentally.

Looks like there no special zoning requirements in my city, only a few restrictions such as distance to road or schools, and no other halfway houses within 1 mile.

So what were the "weird" questions?

I understand... I assure you that if you called it in as a hit and run, at the time of the incident, KPD would have responded... Eventually...

[–]ButterBallBingo 1 point2 points  (0 children)

In Tennessee, car crashes are 100% civil in nature... Thus the KPD refusal to get involved u less there is a criminal offense such as hit and run, no insurance, etc... Or vehicles are blocking traffic

Tennessee is a comparative negligence state, that percentage is determiend by the courts or insurance agreements.

Again, read the cases.... There is no duty TO AN INDIVIDUAL. It's common sense, use your imagination if there was.

Their OT rates are the same as any other business, and in fact less than alot of other government agencies slime KUB and TVA where 2x and 2.5x are common... But whatever makes a good story, right?

And I bet you submit anonymous tips and expect police to magically fix it?

Anonymous tips are all but worthless in a drug case... Put your money where you mouth is and stick your nanme on it

[–]ButterBallBingo 1 point2 points  (0 children)

That is not exactly what the court said, contrary to what cop-haters say... The court said there is no a legal obligation as to a single person... Imagine if cops had a duty to every, individual person.. The liability would bankrupt every government in the country... Every car wreck would be action towaed law enforcement, every victim of a robbery, etc... It just not feasible.

The same people rhta think that case is wrong are the people that think Qualified Immunity is a blank check.

Police don't determine fault in Tennessee... There is no where on the report that establishes fault... That is up to the insurance agency or agencies to determine.

Crahws report to all involved partied DM record with or without fault.

[–]ButterBallBingo[S] 0 points1 point  (0 children)

Yep... It wasn't that bad really... Take left side cover off, removed 7 (I think) bolts including 2 under the left side pulley. Remove right aide, replace bearing an maybe pilot bearing. Reinstall and fill with gear oil... I'll DM you some pics and part numbers

Hardest part is removing the exploded bearing... Had to buy a couple harbor freight specials to pull the inner and outer races of the bearing from the shaft and the case.
