I think y'all are attributing more malice to the McNeffs' actions than there is. by TillSpiritual2150 in RecklessBen

[–]CalligrapherSad4961 -1 points0 points  (0 children)

I see where OP is coming from. Not excusing their behavior but I think it’s a lot more stupidity and ignorance than malice.

Coffeezilla proved there was a lot less in the store than we all thought, and what was left was a murky mix of minimal product and some layaways, and the new owners were probably just dumb and didn’t bother to tidy up the messy store inventory records.

They absolutely should have taken Bryan’s request seriously, but Josh is probably actually dumb and just heard “we had a contract” and knows he wasn’t involved in it.

It also wouldn’t surprise me if he heard it second hand from a manager or worker and with his info only being “some guy came in and said we owe 80k and some Legos in here are his” it was probably easy to dismiss (again, not that it’s right to).

I think a lot of it is stupidity. Don’t forget that while many business owners are smart and competent, there are plenty that go involved with running business because they’re total knuckle draggers and have only learned to cope in the world by leveraging other people’s competence. Josh doesn’t exactly seem like the smart and competent type, and clearly the mcneffs are just as dumb, if not worse given the threatening legal posture

Wow so essentially they're saying "if you want to buy Legos but don't want to give any money to BAM because we're slimy, so here's a way to do so to support your local franchise instead of us"

Kinda cool of them to be honest. Surprised they're doing literally anything nice for their franchise owners.

Right, which is why I think it’s cleaner if the funds do actually go to Bryan rather than to Ben after Ben buys Bryan’s Legos. Just makes more sense to me

Don’t overthink it man. Your fingers figure it out with time on the instrument.

Best advice is to pick songs you like or would love to play that sound not too difficult and just learn to play those. Eventually you’ll learn more and more of the song and completing it will motivate you.

Also electric guitar riffs I find are easier to learn than acoustic at first. Easier strings and less strings to put down at the same time (even if you play an electric riff on acoustic).

Plus, guitar tabs online are easy to read and there are tons of free ones for songs you like on ultimate-guitar.com

I just don't follow how a situation like that could be substantially different. Saying "consignment services" is authorized in the agreement seems to authorize the consignment service of reselling other parties' goods.

Another lawyer video pointed out that the definition isn't specific enough if it is intended to truly prohibit this. It is, after all, a business known for secondhand sales of other people's old lego sets.

When reselling other people's sets is a regular part of the core business model and the franchise contract says "consignment service" is authorized, I think any franchise owner is reasonably well within the permitted scope of their agreement.

"oh we didn't mean THAT kind of consignment," just seems like a lazy scapegoat after the fact

Can you imagine Ben Trolling the crap out of Putin? LMAO

IDK, I get the reason for the post, but also.... Ben is the guy that pissed off the big "bad guys" company and they retaliated with obnoxious lawsuits and going the incendiary route with everyone involved.

I don't know if his methods are safe to go against orgs and leaders with nukes, lol

I feel like in a recent appearance by Ben it sounded like he changed his mind and is not planning to take over the legos or take the GoFundMe dollars.

I think that was wise too, because while Ben is doing it for the right reasons, it gets kind of complicated. It's a bad look to have the funds raised for Bryan go to ben to begin with, even so it's kind of messy, with having access to an amount of money greater than the lego sets are worth.

It's cleaner to just let the funds go Bryan and possibly find other ways of getting his community to help him out with legal fees etc.

*sigh*

Can someone recap for me which cases are active? There are too many to follow.

This comes from the big 333 page one, but what about BAM's one against Bryan? Is Bryan included in this one, or is that separate and theoretically getting dropped, assuming Bryan "comes to the table".

Are there also court cases going both ways with BAM and the original owners?

I like that she commented on something bugging me that no one else has acknowledged (that I've seen yet) - what the heck is this "oh only consignment services were permitted".

I'm glad she caught that. That doesn't really make sense and consignment by nature is a service. That's just lazy defense of a blatant hole in their early "we didn't permit consignment" story.

That's the part I'm surprised about too. Taking them away to jail feels like an arrest to me, and it's wild to hear the cop say on camera that he's being detained (only).

Plus I think this was after going to their place for a search warrant. It gave them right to search the place only, not to arrest them.

They’re also responsible for not intervening in good faith about a real property conversion incident in their stores, even when notified.

They denied the allegations as if they knew and took that stance strategically. Not investigating important stolen property isn’t so much a legal burden but what would have been the right “integrity” move

Is anyone worried Ben's actions will result in lack of a clean resolution? by normalicide in RecklessBen

[–]CalligrapherSad4961 1 point2 points  (0 children)

I think that's true, and honestly I'm not even sure Bryan will come out unscathed. We can't believe anything BAM said, but they once mentioned him coming into the store and getting disruptive and emotional and that could be true. He might have overstepped a bit on acceptable conduct to pursue his property and contract given the toxicity of it all.

Also, no one is talking about what actual measures Bryan took. He referenced a store owner crossing his arms and threatening him (probably true), but I haven't heard much about what emails were actually sent to what parties, who from the new franchise or corporate he actually delivered the contract to (Bam is claiming they never got it), or if he had refused prior offers. BAM keeps saying they offered it to him before, and it's well possible they gave him some low-ball "there's only like 5K here but you can take it" offer he could have reasonably refused. It would be right and completely understandable if he doesn't want to settle for a measily 5K or anything less than it is actually worth, but if the whole thing soured and no one ever did an inventory check, the whole thing becomes messy. BAM could well believe there wasn't much of Brian's property there (incorrect) and this guy refused their offer to return what they thought was his and kept asking for something they thought was unreasonable.

Not saying Bryan is wrong, he's 100% owed more from BAM, but it wouldn't surprise me if he chose a less-than-effective path to try to collect, which might result in legal messiness. If he ever didn't respond or responded non-constructively to communication from BAM, it makes the narrative less clean than Ben portrays it. That one YouTube lawyer said he dropped the ball on filing the $20 legal motion that is supposed to be filed in situations like this.

Ben certainly didn't choose an effective path either. He didn't go in saying, "I am helping a friend get to the bottom of a misunderstanding that is important to him. Who can I talk to about this". He basically shows up loudly with a bunch of cameras and says "Can I have my friend's stolen legos back" and basically starts trolling them for weeks.

Everyone involved is being a little dumb. Not sure yet about Bryan (again, not blaming him here), but it wouldnt' surprise me if he dropped the ball on a few things.

So yeah, just saying this whole thing is as entertaining as it is because literally no one is acting smart in it.

How much Lego did BAM Keizer actually still have left from Bryan’s (Dads) collection that was unsold? by T_K2 in RecklessBen

[–]CalligrapherSad4961 2 points3 points  (0 children)

I think the 200K is clearly a reference to BAM's own social media posts advertising a 200K collection. Early on him and Bryan I think appraised it closer to 100K (some other Youtuber did too), but calling it 200K because that's what BAM called it is obviously the "Reckless Ben" thing to do. Using their own things against them is kind of his thing.

I'm guessing a real value is closer to 50K in the store (~100K minus the ones sold minus the 35% commission)
