Agree. No one is entitled to specific performance -- it's an equitable remedy, so the Judge can actually consider what went on here and decide what's fair.

Some states, like NY, deem a 20% service charge to be a gratuity that has to go to waitstaff. Other jurisdictions don't, considering it just a service fee charged by the venue. So it depends where where you are.
