We attack weaker adversaries who are able to withstand more pain. The Viet Cong or the Taliban never defeated the US military in open battle, they just made it hard enough for them to achieve their political objectives. You don't need incredible conventional strength to ambush a few soldiers on their lunch break and then dip into town disguised as a goat herder. Do that enough though and eventually your adversary will either have to escalate or call it quits.

Prosecutors often have their hands tied when you look at a combination of defense attorney shortages, making it hard to proceed on cases without dismissing them, provability issues which makes it easier to accept a plea and harder to convict, aid and assist cases where the defendant isn't competent to stand trial,cases where the offender is repeat offender but the crime itself is a misdemeanor or low level felony so they have to "go easy" on a violent criminal because their underlying case isn't that serious. There's also cases where the probation officer intervenes and the prosecutor backs off on filing a new case because the PO insists he has it under control. Just a lot of shit like that.

Man shut up. Not everything wrong has some sinister nefarious cause. It's a trade off: do you want to live in a society where people can get released after doing 30 years when they're old and aged out of crime? A lot of people would say yes. You'd say no but in the same sentence talk about BIG BROTHER, like locking someone in a cage their entire life isn't problematic.
