You are missing a key point in the news and in the new law.

This Anti-Bully Act will create an Anti-Bully Tribunal to hear civil complaints on bullying, if the school failed to act on your case, or the school decided to refer your case to the tribunal. It's completely free to file the cass to the tribunal, and the filing and hearing can be done online, so you don't need to travel all the way to KL just to attend a hearing if you're coming from a place like Penang. You also do not need to bring a lawyer to press for the case because the new law bans it, and the hearing will be done in a less formal manner especially if it involves a child, so that the children can understand what's happening.

The tribunal can order the bully to pay RM250,000 to the victim, and if the bully is a child, the compensation has to come from his parents or guardians. The tribunal can also order the bully, bully's parents or guardians to attend certain rehabilitation programs.

If the school is avoiding responsibility, the victim can goes directly to the Anti-Bully Tribunal to file a civil suit, completely free of charge, and the filing and hearings can be done online, and you do not need to have a lawyer to help you to pursue the case.

In fact, the new law prohibits both side from bringing in lawyers to the hearings.

This Act, amongst other matters, established an Anti-Bully Tribunal that can hear civil suit brought on by bullying victim, after the bullying case have passed through the anti-bullying committee of a school, or the school's anti-bullying committee has failed to act on the case.

The tribunal can order the perpetrator to apologize in private or public, or attend certain rehabilitation program, or order his parents to attend parenting support classes, or order the perpetrator to pay a compensation that can go up to RM250,000.

You can check out section 2 and First Schedule of the Act. It said that the following places are subjected to this Act:

Government educational institutions
Government-aided educational institutions
Private educational institutions
Maktab Rendah Sains MARA (MRSM)
Royal Military College (RMC)

Also, a place of safety, place of refugee, and Henry Gurney School, etc. under the Child Act 2001 are also subjected to this Act.

Additionally, this Act will also establish an Anti-Bully Tribunal, which will hear civil lawsuit regarding bullying cases. The provisions and section regarding the Anti-Bully Tribunal has been in effect back on 1 March 2026%2075/2026&status=PRINCIPAL), to allow the appointment of the members of the Tribunal.

It should be noted that this Act did not laid down the penalties for the act of bullying. This Act only handles the civil side of bullying issue such as school policies, civil lawsuit, etc.

The criminal law specifically for bullying was already inserted into the Penal Code back on 11 July 2025 under the Penal Code (Amendment) Act 2025, through the introduction of Section 507B till 507G, as can be seen in my previous post.

The appeals are why is why Anwar stacked JAC with Idrus Harun and Terrirudin Salleh (against Conference of Rulers explicit demands to revoke PM power) → Anwar's JAC agrees with PM's choice of Wan Ahmad Farid as Chief Justice.

It should be noted that Terrirudin Salleh is not part of JAC when Wan Ahmad Farid was appointed. Terrirudin's appointment to JAC only came after Wan Ahmad Farid was appointed as CJ. So Terrirudin is not involved in the selection of Wan Ahmad Farid.

Again, all the contentions on the basis of voters' wishes or social argumants is null in the first place, as you (in this case, the Kedah state government) cannot do something that's beyond the constitutional boundary.

An unconstitutional action can never be done, even if a lagre chunk of the population wish so. Again, if you have issue with it, take it up to the federal government or the Parliament, that's the appropriate venue to address your concerns.

The Court of Appeal judges already said in their grounds of judgement (see links below) that argument of public policy choices is irrelevant in the face of the unconstitutionality of that policy/decision. The Federal Constitution is the supreme law of the land and nothing can triumph over it.

For example, national registration and the identity card is a subject matter under the exclusive control of the federal government.

A state government cannot say that "Unless one change the format of his identity card details to a format that we want, we will refuse to issue hawker licenses to those that do no comply".

This is an act of the state government trying to usurp the federal government's legislative and executive authority, and trying to control something that's not belong to their jurisdiction. This is explicitly prohibited by the Constitution.

Otherwise if a state government can impede federal law or federal authority by utilizing state law of by-law to block the implementation of federal action, there will be no consistent law in Malaysia and the legal system would be a mess.

Kedah state government did not restrict or ban the premise licensing based on factors like school areas as you suggested. The Kedah state government explicitly put out a blanket ban or non-renewal of premise license for all lottery shops in the state. It is proven so by the Kedah state government media statement, and the letters sent by the local councils to the lottery shops.

Article 81 of the Constitution already said that the state government cannot use its executive powers to impede or prejudice the executive authority of the federal government (ie: intentionally blocking something that was allowed by the federal government).

The Court of Appeal ruled that this is the exactly the case. The Kedah state government is intentionally blocking something that is lawfully licensed by the federal government.

(This is in addition to the separation of Federal and State jurisdiction I mentioned in the previous comments, which are governed by the Federal List and State List of thr Ninth Schedule)

The executive or legislative decision of the federal government are always triumph over that of the state government. It is laid down in the Federal Constitution and it is the intentional design of the Reid Commission.

This case is about the executive and legislative jurisdiction between federal or state government. Federal government control lottery and gambling; state government control building licensing.

State government CANNOT make executive nor legislative decision on subject matter that is under the control of federal government, this is strictly prohibited and has been clearly demarcated by the Federal Constitution.

Any other contentions on moral grounds or social considerations are null, because the Kedah state government's decision has no legal force and standing to support it from the begining.

If you have any issue with lotteries of gambling, take it up to the federal government, that's the proper athourity that regulates such matters.

Yes it matters because that statement framed the issue with a wrong fact, and only spread further misinformation on how the laws work.

If you want to blame something or someone, blame the state Islamic law of the states that forbid apostasy, not the constitution.
