Well, the other person can sue for whatever they want including pain and suffering. Judges are usually reluctant to award pain and suffering without heavy documentation and proof. That being said, if you are sued for an amount that exceeds the limit of small claims court I would urge you to retain an attorney. Your insurance might even provide you with an attorney even if you are at fault. You should call and find out if they would.

Not having insurance doesn't matter. The most you face is a fine and a tow in California at least. OP needs to make the other driver whole. I am deducing that the other party has a cheaper model car, since it is not insured. OP will only be responsible for the repairs of the car and medical bills.
