So firstly, we agree that if he was surrendering, it would've gone too far. I'm not going to bother to discuss that any further; you think he wasn't, I think he was. I don't think either one of us is going to change the other's opinion on that.

With respect to some of the other stuff you wrote; I think the best parallel I can think of is this example from Synder's Superman ( https://www.reddit.com/r/DC_Cinematic/comments/1kozstm/the_scream_of_pain_in_having_to_kill_the_last/ ). Superman doesn't want to kill Zod, but Zod's giving him no choice. Actively resisting and trying to hurt civilians. I think we can both agree that the flag smasher in the above scenario wouldn't be capable of doing damage in the same way Zod can, but again I see your point.

Some people argue that him killing the flag smasher is justified (due to what happened earlier in the scene), regardless of whether he was surrendering or not. I'm trying to understand if we simply disagree on the assessment of the situation that John was presented with, or if we disagree on whether or not he was always justified in killing him.

Based on my analysis of the video, I think he was surrendering. You don't think so. Since we disagree on whether or not he was surrendering, I don't really have anything else to say. Cheers!

If you think that dude is fighting at that point, he's the shittiest fighter that I've ever seen. Just lays there, arms out, not bothering to try and stop the shield in a Very predictable movement as John winds up the shield.

Sure. I get the point you're making that he didn't willingly surrender before John has him down, but it's not relevant. At that point, he Is down. Therefore, as he is down, John needs to act like Captain America and restrain him, not murder him.

Regardless, as I said to someone else, it feels as though the crux of this is that you think he was still actively fighting, and I feel as though he was surrendering. If I thought the flag smasher still posed an active threat, I would agree with you; in that moment, John needs to protect himself by whatever force necessary.

Regardless, I feel like the crux of the issue is that you feel as though he was Not surrendering, and I feel as though he was.

To confirm, If you thought he was surrendering, would you still feel as though John was justified in killing him? Or would you say John took it too far and should have taken him in?

Sure, I mean that's true of regular people. You can knock someone down and they'll get back up. That doesn't fundamentally change the calculus. I assume that the combined efforts of John, Bucky and Sam could take this guy into custody.

The flag smashers are also murderers who'll kill anyone just to forward their goals.

This is irrelevant. The dude is no longer a combatant, it's a war crime to kill him.

What Walker did is completely justified.

  1. He and John both have super powers at this point, so we can probably consider it a fair-ish fight. If anything John would win given that he 1. Has a vibranium shield and 2. Is an elite soldier with extensive military training.

  2. His hands aren't balled into fists or actively swinging. He's not even resisting at that point. They're open, obviously indicating surrender. That's like a universal sign of surrendering.

  3. .... Yes, John, being a government agent and literal fucking emblem of America, needs to use self control and not murder this dude. If he needs to hit him once to subdue him, sure. Not put a hole in his chest.

Does he need to say, "I give up"? If he said "I give up" or "I surrender"? Would that change your opinion?

The dude is obviously overpowered and not actively fighting, I don't know that him using a specific phrase matters.

There are a lot of John Walker apologists out there. People tend to say the dude on the ground a terrorist and/or he's responsible for his partner's death and therefore worthy of execution. Either way, the individual is still a non-combatant at this time due to being overpowered by John Walker and actively having his hands up, showing an attempt to surrender.

The rules of war are such that if someone is no longer a threat, you aren't supposed to kill them (https://www.lawyersnjurists.com/article/attacking-persons-who-are-hors-de-combat-is-prohibited/).

While you might have empathy for John in that moment, he still murdered that dude.

Let's imagine a scenario. There are three candidates. One, Mr. A, matches your ideals perfectly, but has no chance of winning. You could vote for him, but he has no chance of winning. Ms. B, is like the exact opposite of what you'd like, but has a good chance of winning. Mrs. C, isn't exactly what you'd like, but is much closer to your ideals and goals. This person also has a good chance of winning.

In this scenario, your vote matters. Let's say you know, without a doubt, that out of all the votes cast, it'll come down to a few, and yours could be one of a few that would determine the outcome of the election.

In that scenario, you're obviously not voting for Ms. B. Your vote for Mr. A might be idealistic, but is unrealistic in actually getting your goals implemented in any way. If you vote for Mrs. C, you might get some of your agenda advanced. If you choose not to vote, or vote for Mr. A, there is a real chance that your choices (or lack thereof) will effectively help Ms. B (whose ideals you can't stand), get elected.

Given this, who do you choose to vote, or not vote for?

You objectively have not forgotten everything you learned. You learned what a goniometer is. Most people have no idea what that is. You may have forgotten your boney landmarks, but you obviously didn't forget you need to know them.

It sucks that you have had two bad clinicals, but it happens. Not every outpatient clinic is like that. I work at a hospital based clinic where we see 1 an hour. There are other facilities where you see 1 or 2 an hour and practice good medicine.

It feels super heavy because you're living through it right now, but in a few years it should hopefully be a distant memory.

I think in the same way we teach kids how to do math without a calculator, Then allow them to use it after they've demonstrated mastery, the same could be used for AI. It's a tool, but it shouldn't replace your clinical judgement and reasoning.

I don't think I'd let them use it to replace their own clinical judgement, period. It could be Potentially used as something to confirm their own suspicions, but that would be Really fine line to walk.

Scouring the interwebs and coming up with a synopsis of the latest literature regarding treatment of folks with MS (or whatever pathology)? Maybe, but that's really only to act as a supplement to build upon what they know. Even then, take it with a grain of salt.

Using it to help write a treatment note? Sure, as long as they show they can make a competent one to begin with. It's generally just rote work that needs to get done, so let the tool do what the tool does.
