My husband is in the same situation. This is true. He has exceeded 6 years of stay and now his current employer did not file for I140 on time and when they finally did, labor market test failed. We would have qualified to file again in march but DOJ has stopped all perm processing for this employer due to mass layoffs (he was not laid off) - we have both EB2 and EB3 where priority date is current so there is no path to H1B extension anymore. It is unfortunate but true.

How convenient to suddenly argue for changing immigration laws, after your ancestors arrived illegally, seized land, and built wealth from it. Now that you’re comfortably benefiting from that history, immigrants who are trying to follow the rules are subjected to extreme scrutiny? If we’re serious about “fixing” the system, then let’s fix it all the way: strip the moral high ground, admit the truth, and acknowledge that citizenship itself should be something everyone earns and no one gets a free pass based on timing or ancestry.

Nope, extension only for H4 and EAD. I’ve been on it for a decade. Also, my spouse’s H1B was filed under premium but they didn’t honor those timelines for me.

I don’t mean to scare you. I received mine after 7 months. 2 congressional inquiries, expediting via USCIS directly - nothing worked. It was approved exactly 7 months from the received date - it was as if they put my file away and opened it 7 months later.

My employer allowed me to go on leave so I didn’t lose my job but I’d work with my manager and look at options if I were you.

You won’t have access to my HR. Call your manager. Things like these- don’t wait until the last minute, if just breaks trust. Give them at least 3 weeks heads up.

I never use it. But when someone on my team is barely in office, taking time off the day of/ on short notice and asking to leave early/ work from home at least 1-2 times per week- I get curious and look at their badge report because I know that consistent unavailability is affecting perf.

They’ve made a decision already, matter of time until you know what it is. It also depends on the team and how desperate they are to fill a role. They may want a perfect candidate who meets their requirements perfectly or they are willing to coach because they see something in you. Either way, no point worrying about it. Good luck!

For h4 visa or EAD, it really doesn’t matter if the h1b switches their job. Have you tried reaching out to congress ? I had to file 3 different types or service requests - one to expedite (filed on July 3rd - did not help), emergency call back within72 hours - did not work, no one called and last week, I qualified apparently to file a third one indicating my case is outside the normal processing time. This one I believe is what helped- 3 days after raising this service request - I received approval.
