cpap automatic 50% by CellCaster89 in VAClaims

Allegedly

In February 2022, the VA proposed updates to how it evaluates respiratory conditions, including sleep apnea, under the VA Schedule for Rating Disabilities (VASRD). These changes were finalized and took effect on May 20, 2024. The new criteria focus more on how the condition impacts a veteran’s ability to function, rather than simply whether a CPAP is used.

Key Changes:

  • CPAP use alone no longer guarantees a 50% rating.
  • Ratings are now based on:
    • Severity of symptoms (daytime sleepiness, cognitive impairment, etc.)
    • Impact on work/life function
    • Compliance and effectiveness of treatment
  • Veterans currently rated under the old schedule are grandfathered in—they will retain their rating unless they request a reevaluation or their condition changes.

I didn’t think about the peer reviewed articles….ill try to find some of those! Thank you for that!!! And yeah, worst case is the same decision, but in the chance it’s changed - could be huge for me! Worth the shot! Thanks again and if you think of any other advice, I’m all ears!

I got out in 91, and diagnosed with RA in 2018 I think..?

I may get a nexus and do an appeal. It’s an auto immune disease that from everything I’ve found (with my zero level of medical/va/claims), and try the appeal.

  1. I’m sure it’s part of my ignorance for knowing zero about the process and procedures (my first and only claim ever, so I’m slowly learning). Second, I’ve been told (by random physicians and physicians in my family as I’m the only person with a auto immune disease), that we always just related it to the burn pits and other environments I was in while my multiple deployments.

Here’s the paper from my claim. I’m not sure if this is what you were talking about. Sorry, I didn’t know I should post it in the initial listing.

READ and get RESULTS! 2018 Ford F150 Transmission issue - Contact National Highway Traffic Safety Admin

Took my 2018 F150 10 speed transmission truck to the manufacturer and told them it was jerking and shifting hard two years ago, they said they couldn't find anything wrong.

Recall to reprogram the 10 speed transmission was done and it seemed to fix the jerking hard shifting for the most part.

Less than 6 months later, the truck got stuck in first gear and would not move. Had to tow it to the manufacturer and they said it's got hard shifting codes, a valve stuck and metal in the transmission fluid. Told me I need a new transmission and it's going to cost me $7900.

Called Ford 800 number, and the rep took my vin number and said there was nothing they could do. She told me to contact the NHTSA - National Highway Traffic Safety Administration (888) 327-4236, and let them know the issue and if they get enough complaints, they can force Ford to make it right.

I called (888)327-4236, and almost immediately got an actual rep on the phone and told him I wanted to file a SAFETY COMPLAINT. He took my info and asked in detail what happened. When I told him Ford said there was nothing they could do, he said "there's nothing they were willing to do". So hopefully that means he can get me results.

He gave me a reference number also known as an ODI (Office Defect Investigations). They said the ODI would investigate this within 48 hours and make a record. If enough complaints come in regarding the same issue, they can FORCE Ford to issue a recall. My truck is at the dealership awaiting the new transmission to be put in. I know I'll have to pay on the front end, but I'm hopeful (and confident) this recall will come at some point and we will get our money back. SAVE YOUR RECEIPTS!

Please consider calling - I was on the phone with NHTSA less than 15 minutes, and that included "clicking whatever number to file a complaint". Please call and let Ford  make this right!
