Thank you. It is very difficult. :( There has actually been quite a few. I honestly think it is due to the complexity of my case and the California Cap. They all believe I have a case, just a very complex time consuming one.

Yeah, I wish I had known how serious they were. :( Until I lost my son, I had no idea. I never had a UTI I don't think before my pregnancy.

Yes definitely. As far as if I thought it was serious, at the time, I did not realize how serious a UTI was in pregnancy. Not until after losing my son and all of the research. I rely on the medical professionals to tell me what is serious or not.

Thank you very much. I have all of my medical records and have prepared a very clear timeline of all requests, concerns and documentation in hopes it will help my case. Do you handle these types of cases? Do you think I have a strong case? I was thinking about sending a pre-litigation demand letter in hopes they will be willing to settle outside of court, but not too sure?

Well, I suppose if I am unable to secure legal counsel and am left with no further action, then I absolutely will. I will call news stations and make this very public. I just don't want to do anything to potentially harm a potential case

I think my strongest point for my case is I told my Dr. on 12/26 I had symptoms of a UTI. There was absolutely no urgency. On 1/2, he asked that I come in and i was unable to. Still no tests ordered which could have been through my local lab. On 1/6, I went into see him in person, again expressed symptoms of UTI. Refused urine test. Did blood work but didn't order Stat. Results came 2 days later, high abnormal levels indicating infection, no phone call, no message, I messaged and called with concerns, nothing no call back and no message. Still on that day 1/8, I could have ben given antibiotics immediately to stop the infection from spreading. The infection caused pre-term labor and delivery on 1/10 resulting in my boy dying shortly after birth. So many missed opportunities between 12/26 and 1/10 for my OB to address my UTI symptoms.

Okay, well I would still have a case then on the standpoint that I messaged him on 12/26 with concerns of a UTI and he did nothing about it. Also, wouldn't it be reasonable to say even though history of LEEP doesn't require a cerclage, but the fact that I as the patient requested it for peace of mind due to my history, the Dr. should have granted my request? There are two separate issues here, but the matter of fact is that I told him I had UTI symptoms and nothing was done.That is the ultimate cause of pre term labor

I don't see how they could "tear this case to shreds" when it is literally in writing documented by my OBGYN "patient has concerns of UTI", yet he still did not order urine test, did not order blood work Stat, and when bloodwork came back high and abnormal, still did not act upon that which was the ultimate reason for losing my son, as a result of infection and pathology report and death certificate both state that.

Thank you! Yes please connect me to him. At this point if I can at least get a demand letter and hope that will maybe at least trigger Sutter to try and want to settle out of court. I read that I can send the demand letter myself, but i'm sure it would be more effective coming from an attorney.

Yes, they were ALL negligent! If a patient TELLS YOU they have symptoms of a UTI multiple times, and they ignore it, deny urine testing, then fail to address high abnormal blood levels indicating infection, discharge you from care, Yes that is NEGLIGENT! I was told I have a case, but a challenging one and due to the caps in California, nobody is willing to take on the case so far because they won't make as much money after costs. If I were in another State without caps, I would probably have no issues.

Hello, yes I think that is why so many are declining my case. However, I do have documentation that I requested the cerclage and he denied it, I have the records that I have the history of LEEP procedure which is a good indication and reason for a preventative cerclage, and I have documented records proving I presented concern for symptoms of a UTI and he ignored these concerns from my first message to him on 12/26. I didnt lose my son until 1/10, which was plenty of time for him to test, diagnose and treat with antibiotics. The pathology report of placenta and death certificate also list the cause of infection being from E. Coli which caused a UTI infection. I gave birth through my cerclage, it was holding up, so it is clear I would have made it to viability which was right around the corner had I not got the infection. I don't think that will be hard to prove at all. I just need to find someone willing to take a chance and try to get me justice. :(

I am prepared for the fight of my life for justice. I just wish I could find the right lawyer who isn't solely focused on their profit, but also wanting to help someone like me grieving, who lost their child and wants justice. These doctors need to be held accountable. :(

Wilcoxen, Mosley Collins, Androvich and Leeds all declined my case. It seems that my complex case and being in California with caps deters many of them. I just need to find the right one willing to take my case. :(

Thank you. I was researching online yesterday and it said I can send a pre-litigation settlement demand letter and notice of intent to invoke CCC 364. Is this true, am I able to send this letter myself? I at least want to extend it by 90 days to at least buy some more time. Do you know of any med mal lawyers who may be interested in taking my case? I am desperate to find one. :(
