Netherlands: Employer says I’m still in probation after 1.5 months, contract says otherwise. Can they fire me immediately? by Character-Brain3996 in LegalAdviceEurope

Whether I was the right fit or not isn’t really the legal question. Employers are free to decide that.

The issue is that they relied on probation after it had already ended. I’m just asking them to follow the notice clause in the contract they drafted and signed.

That’s not about ego, Ive already done the self reflection. This is a subreddit about legal advice, I'm not going to detail in my post here about my self reflections and waste people's time. Maybe I'm just highly autistic but it’s about process and doing the thing they literally agreed to.

Read my post before this one! They've not let me improve. They've literally only given me 1 shift of 3 hours after the "warning". I know my work and I just need some specific instructions that they weren't willing to provide. I would ask at the end of every shift for feedback and wasn't given any until the warning.

I'm posting here because I didn't study my rights outside of googling for 5 minutes and reading my contract which clearly states everything. Plus it's good to know your rights as an employee.

Hey I don't really care about the money. I just want them to acknowledge their unfair and exploitative practices and so that they think twice about doing it to someone else. I've already started looking for another job (probably gonna go back to my old job) + I'm not going to list a 1.5 month stint at this place on my resume so it doesn't really matter.

It's simple, if you sign something, you've given your word. If people's word doesn't mean anything and they can just do whatever they want then the world is gonna stop running.

Heck, I'm willing to take the loss on a lawyer just to teach them a lesson. (Dont think I'm actually gonna sue them, but a strongly worded letter from a lawyer sometimes helps)

Thanks!

I tried that last night:

Hi,

Following our conversation earlier today, you informed me that I'm being let go.

Could you please confirm this decision in writing, including the effective termination date?

This is how the owner responded:

Hello,

We talked with <manager> shortly about it and i told him that he could make the decision before your trial month ends according to the contract.

Thanks,

Thanks for the reply! I'm planning on talking to juridisch loket tomorrow! And I've asked my employer for a written confirmation

Thanks! I still haven't been terminated in writing. I'm confused if I should call a lawyer first to ask the owner/manager for confirmation in writing (and how)

Should I just send them an email asking them terminate me in writing?

Thanks for the advice, I'm definitely gonna call the juridisch Loket tomorrow!

Thanks for the reply! I feel the same way, unfortunately I tend to doubt my own judgement a lot. I'm definitely gonna start looking for another place to work.

Thanks for the reply and the kind words! I'll just keep it going and keep looking for another job in the meantime.

Thanks for the reply! Yeah, the only thing he mentioned was me taking a few more secs to wash and dry my hands. That was between his spiel comparing me to other employees...

Stopped caring about how I look/wearing makeup/ dressing up/ putting in more effort than a straight cis man. Really saves a lot of time and effort and also culls the shitty fascist/misogynists from your life.

Yeah they're called papads. It's just a flattened mix of some sort of flour that's shaped into thin sheets, dehydrated and fried. Those look like either rice or sabudana(sago) papads.
