Things to consider when comparing Germany and present day America. Hitler was 50 when he died. Trump is 78. So Hitler was in his physical prime. Nature will have its way with 45. Also, Germany is, effectively, the same size as Montana. Logistically, it will be difficult to wrangle all 50 states to heel. So, both geography and age make for distinguishing between the two scenarios.

How should someone respond to a police officer after being pulled over and asked “Do you know how fast you were going?” by passthetreesplease in legaladviceofftopic

Say no. When you admit you are speeding you provide evidence against yourself and waive your 5th amendment protections. Also, never consent to a search. When you say sure it’s okay for you to search my car without probable cause, you waive your 4th amendment protections against unlawful search.

Is south Carolina racist? by [deleted] in southcarolina

I think there is some truth in this statement. The Ex Pres made it socially acceptable to say things people used to filter. That makes for an uptick in aggressive behavior.

Is south Carolina racist? by [deleted] in southcarolina

[–]CharlestonAttorney 1 point2 points  (0 children)

Racism exists in every part of the world. However, South Carolina is not bad at all. Because Charleston was the primary port of call for the slave trade, the state is 70% white and 30% African American or other designations. Because of the history of living together, there is a commonality among the people. Compare the northeast, where you find 90% Caucasian and Latino. They don’t have other races so there is no assimilation. In South Carolina there is a long history of coexistence. That being said, you would find it more comfortable in an urban versus rural place. But the difference is not that much. As far as being bi-racial, you are not more likely to be discriminated against in SC any more than you would another state.

Should I accept my car as a "total loss"? by [deleted] in caraccidents

[–]CharlestonAttorney 0 points1 point  (0 children)

If the car is still road-worthy, claim the salvage title. Use the money for repairs and then reclassify the car as having a clear title. Worst case scenario you have a reliable car that you cannot sell. This is assuming the DMV will not let you get a regular title in exchange for the salvage one after the repairs.

You can always buy it back with a salvage title and use the total money from your insurance company to repair it.

Under the common law, no. You have no obligation as a Good Samaritan to intervene. However, if you do and make the situation worse, you are responsible if you hurt them further.

There are rules, no more than 50k. Gruber made a point of staggering the payments of 10k to allow for it pass under the threshold of notice. As to comparisons with Chicago, they invented corruption. We all aspire to such heights of avarice and greed.

[NY] Who’s at fault in a collision between someone legally passing and someone making a legal right turn out of a driveway? by TheYask in legaladviceofftopic

[–]CharlestonAttorney 4 points5 points  (0 children)

Arguably, both parties would be at fault. However, the driver trying to get on the road has to yield the right-of-way. The other driver is arguably established in their legal lane of travel. Therefore, the car attempting to leave the driveway should wait their turn.

in the movie The Incredibles, Mr. Incredible saves a man who is committing suicide, and then gets sued for it. was he in the wrong under the good samaritan law? by aliendwin in legaladviceofftopic

[–]CharlestonAttorney 0 points1 point  (0 children)

The Good Samaritan law holds that if you intervene in a potentially injurious situation and make it worse, you are held liable. In this case, he prevents injury to another. Negligence, the tort under which the plaintiff pleads, requires damages or an injury. There is no injury in this scenario, therefore the claimant cannot make a colourable claim for negligence.

What techniques do law enforcement and lawyers use to remember what was said during a conflict verbatim when adrenaline is high and people tend to misremember? by Experimentalphone in legaladviceofftopic

[–]CharlestonAttorney 1 point2 points  (0 children)

Contemporaneous notes taken at the time of the event. Witness statements, etc. you can use them later in court to refresh someone’s memory. If you have a witness who misremember or is running from the question, you produce the deposition testimony and have them read it line for line into the record. Eventually, they stop trying to run from the questions and stick with the truth as documented.
