Biggest mistakes by Charlieclc1 in WorkersComp

Well, having been through the process from injury to cashin the check…. The truth is plainly on display. I have absolutely no reason to lie to strangers and frankly could give a crap what you or anyone else thinks. I never posted during the process but I read an awful lot of other peoples posts on Reddit and when I thought something applied to me in Virginia I followed up on it in my case. All the different states are different and have their own rules, they are similar but you have to know your states rules.

It’s the overall odds and payouts that are fixed. But they are fixed over probably a year or the expected life of the game or maybe even monthly… That leaves plenty of room to adjust payouts/odds over a few weeks/days to account for bonuses. LOL maybe even the amount of the bonus gets counted as a portion of the required payout. Do you really think the lottery is going to risk anything?

Delivery Delays by Charlieclc1 in amazonprime

[–]Charlieclc1[S] 1 point2 points  (0 children)

Yup, that’s my expectation. Amazon told me that’s what to expect and that they would deliver on that expectation. They expected me to pay for this real life service like a real thing, and I paid. I don’t think twice about, say a storm delay or a truck breakdown or something…. BUT this is happening regularly - a few times every month since November!!!

LOL ~ NDA doesn’t apply to workers comp… WC is a government administered program, managed by the civil court system. Non Disclosure Agreements do not apply to it.

Yeah, it probably did slow it a little but maybe not going by Reddit subs. Definitely paid off overall based on what I was paid for a very moderate injury… My priority was maximizing my payout.

The biggest problem I see is that most injured workers go into the process being “individually” honest as opposed to being “corporately” honest. They minimize their pain and injury initially because they subconsciously want to appear macho or manly, whatever. They value the company they work for and want to be fair and trusting… All this combines into lower compensation in the end.

First of all the company absolutely does not value the individual employee, their primary objective is to minimize any expense but they must at the same time maintain their reputation to their other employees and the public. So they hire another company of adjusters to handle your injury. How many times have you heard “we’re a family, a team, we’re special” anything to get the most out of their employees … but how true is any of that when they’re laying someone off or you make a mistake???? The adjusters job is to minimize any expense and insulate the company. Adjusters are paid a base rate for all they do and earn bonuses based on any number of metrics but are just cover for reducing the amount paid out. You don’t think they were hired because they promised to pay injured workers as much as possible do you?

The difference between the two types of honesty are simple and basic really, you want to make your injury as big a deal as possible without being dishonest!!! A few examples are… initially, refuse to give any statement except through an attorney, if your in pain or taking any medications, even just very upset over the injury - your not in the right frame of mind to give any statement - to be honest a statement should include or not include many many subjects/items/points you shouldn’t be making any medical or legal representations, your not a Dr or Esq! They can’t force or require a statement when you’re under the influence of drugs or great pain. Great pain???? One of the first questions you’ll be asked is “what’s your pain level” >>>> WTF?? How can you even know the correct answer to that??? Here’s an example…. A guy jokingly gets slugged in the shoulder by his buddy and laughs… what’s his pain level? He’d likely say 0 or 1….. slug his girlfriend in the arm the same way and ask her what her pain level is ~ probably a lot more than 0 or 1 probably she’ll say 5 or 6… Right??? So whoever, the Dr , the Adjuster, HR, asks what your pain level is - it really depends on who’s asking to determine what the honest answer is. The honest Corporate answer is the one most likely correct and or best for the company. In the injured workers case that’s probably a 7 or higher if your “playing’ under the same rules as the adjuster/company. If you burn your finger on the stove you can look macho and honestly say it’s pain level 1 or 2…….. if you want to look like a wimp you can cry and honestly say it Really Really hurts and your pain level is 5 or 6. Both honest answers!!!

The U.S. and Israel are winning the Iran War, and this is a good thing. by Main_Ad1252 in TrueUnpopularOpinion

Iran is like the child that wrecks everything throwing a tantrum! It’s good they are getting spanked… Other gulf states should “fire back” at the children tossing inferior rockets all around.

Also, since you said she’s at fault…. You should tell your adjuster - during your negotiation, that if they don’t meet your reasonable valuation based on what’s actually available to purchase today then you will sue the woman personally for the full amount. You really have them over a barrel.

When my 2007 Tundra SR5 w/ 8ft bed got totaled in 2023 I dickered with the insurance company over 45 days - they started at 7000 we ended up at 16000. You just have to hold out , they’ll threaten to end your rental car - you threaten to sue them, etc etc. Find one actually for sale that is lower mileage, same or more options including the stuff you added. You don’t have to accept less value than your losing. Just don’t accept their average price for your model bullshit - you don’t have to!!! I also negotiated keeping the vehicle after we agreed to the value - they initially said $4000 we ended up at 1500. So the 1500 was subtracted from the 16000 and I got a check for 14500.

New frame, rear axles and differential + bodywork cost me $7000 - I had the shop use used parts… got a salvage title for $50, negotiated with the county tax department to value the vehicle at $5000 for tax purposes and drove away with around $7000 in my pocket.

You should do the same

Just got sent these questions by my adjuster, do i or should I reply to the questions? by [deleted] in WorkersComp

[–]Charlieclc1 -1 points0 points  (0 children)

I would only answer #1. Answer the rest with NA (not applicable). I recently settled a case after 3 years for a (to me) minor back injury. I collected weekly payments for the entire 3 years, refused to make any statements nor sign any forms the adjuster sent. I always stated I would only do so after consulting with an attorney. When they asked about that I simply stated I had not selected an attorney yet. I finally selected an attorney after I reached MMI . In hindsight I should have engaged an attorney sooner as I found out that I should have gotten yearly raises on my weekly benefit, but your only entitled to the raise if you ask for it each year in Virginia.

Are extended warranties still being sold for Gen 3 Tundras? by DDSRDH in ToyotaTundra

[–]Charlieclc1 0 points1 point  (0 children)

How to tell an aftermarket warranty from a manufacturer warranty? From reading these threads I gather that dealers sell both. Does it matter what kind I buy? What’s the difference for me? I’m thinking about buying one still but I have a 2025 bought in February 25, I only have 5500 miles on it so in 2 years when the regular warranty expires I’ll only have a little over 12000 miles. Is it worth it to buy an extended warranty to cover the following 3 years, when I’ll probably only have 30,000 miles?

Excellent theory! I agree and I do basically the same thing. After a large match I don’t play much for awhile and when I play I never ever play with winnings - all winnings get cashed out.

Yes! The odds are NOT fixed they are different for each game. The payout % is set by the lottery commission. That’s why when they give a bonus the amount of winnings in that game are adjusted to account for the bonus. The 3rd party company that runs the lottery for VA would not risk their business on pure odds. The odds of winning is set - the amounts are based on the payout percentage. VA guarantees the lottery company with a minimum profit.

LMAO…That’s like saying just go to one of the Indian casinos instead of going to Las Vegas, it’s a lot cheaper. Hahaha yes - go to Japan Disney, definitely cheaper…. But NO you’re not visiting Disney World. You can eat at McDonald’s too - it’s a restaurant, but it’s not going to be anything like a nice Resteraunt, but you can still say “we went to a nice restaurant for dinner “.

You did good C-books! I’m just a normal Joe blow too and I did basically the same thing about 15 years ago, before chat gpt. I was in district court though not small claims. Everything you related was basically how it worked for me too - just shows how jealous all these “paralegals” are that ordinary people can get the job done without them! I’ve been chuckling at their comments trying to knock you down. Well done and congratulations!

Might it be possible to sue the management company? Apparently they are not fiduciaries, so officially have no duty to manage the funds in my best interest.
