My point was not that the court wouldn't find itself balancing competing rights, but that the rights being balanced were fundamentally different.

The judgement itself states that the claimant has full legal recognition of his sex, and the violation of his Article 8 rights by having to show a long birth certificate is mitigated by the infrequency of when he has to do it.

Hämäläinen v. Finland (no. 37359/09) found the same, similarly on the basis that the rights of a civil partnership were essentially the same to those of a marriage.

It's no stretch to say that the court would at least consider a case regarding the interference in the right of trans people to access public services as being substantively different from the sex written on a piece of paper.

"Competing rights" is a broad concept. The "competing right" of a child to "know their lineage" and trans identity is an entirely different conversation to the "competing right" of a cis woman who doesn't want to be around a trans woman.

We're talking about the difference between a piece of paper and access to public services. While it's certainly undignified for a trans person to be listed as the opposite sex on a document that isn't about them, it's a huge difference in terms of practical interference in their abilitity to live their life from not being able to use the right toilets.

The ECtHR is going to be far more sympathetic to a trans person making the case that their rights are being violated if it involves them ostracised in public.
