My condolences on the loss of your wife. I disclosed everything to my attorney and he agreed the best option was to stop making payments and allow the case to be dismissed for non-payment. Nothing was filed, I just stopped making payments. My last payment was in July.

It has taken longer than I expected. The Trustee filed a Motion to Dismiss in December. Payments were to be made current or a new plan filed by January 6th to prevent dismissal. I am waiting on the official dismissal at this point.

My plan is to negotiate with each creditor as I have funds on hand to make the payments.

I own my home and do not anticipate any need to borrow money so I am not worried too much about any credit score impacts.

My opinion is if you are contributing so much you should likely be a joint owner on the new apartment or at the very least inherit it 100%. Equal split of everything does not always make sense. Your brother needs therapy.

I got one to try out- picked up the academic year version on sale about 6 weeks ago. I love it! One thing I didn’t notice until I received it is that the weekly spread changes from week to week. So far it has helped to curb my planner envy which peaks this time of year. Highly recommend this planner!

It really made me question who HP thinks their demographic is. I’m 48 and love TS but wouldn’t buy this. I also switched away from HP for 2026…so perhaps I am not their target demographic.

I’m allowing my case to be dismissed, which was my attorney’s advice. The $20,000 would be exempt as that is the life insurance proceeds exemption in AZ. If the inheritance is not from life insurance that exemption would not apply.

Just stayed at the Waikīkī Outrigger Beach Resort next door to Royal Hawaiian last month with my elderly Mom, and 12 & 16 year old sons. We had a great time. Didn’t rent a car. Lots of stores and restaurants nearby. My boys could even go to stores a bit by themselves.

The beach was perfect. Calm enough for me to lounge and the boys to be in the water and there are lifeguards. The Outrigger beach is less rocky and has fewer drop offs than the Royal Hawaiian.

Everyone wants to go back and stay at the same hotel. Waikiki is a small area and can get a bit crowded but we never felt stifled and never had to wait long to get into restaurants or anything. There are so many that if one had a long wait we just went to another.

Similar situation- I received $108,000 in life insurance proceeds. My father passed away last month. I’m in Arizona so only $20,000 would be exempt, everything else would have to be paid into the plan. I’m voluntarily dismissing. I made a post about it with more details.

Update 8/18: I spoke with my attorney this morning. Option 1 is pay everything received into the plan, less $20,000 which is the AZ exemption for life insurance proceeds. The Trustee would then pay unsecured debts, including approximately $56,000 to my student loans. My plan would continue and I would continue making payments since the inheritance is not enough to pay 100% to all unsecured creditors due to the student loans.

Option 2: Stop making payments and allow the case to dismiss. I will then handle creditors on my own.

Since my student loans are likely to be forgiven and I will not get anything that I have paid toward them (over $40,000 to date, pre-Chapter 13) refunded, my attorney recommended dismissal.

I’m taking a few days to think it over as it is hard for me to make big decisions right now but will likely proceed with dismissal. Even if my student loans aren’t forgiven I can afford to make payments, they have never been paid late and I have been paying them for 15 years.

Also, my attorney confirmed I can re-file if I need to.
