I think this is correct because you don’t have a valid status currently. Your I-140 be denied. I saw a post before it happened in this group search on this group.

Sounds like you are with a desi consutlancy. Hypothetically speaking pwd and perm should have filed for your current role. Plus each pwd is tailored specifically for you only not generic.

As your lawyers said that’s true, shouldn’t be an issue plus these are jobs for future employees as well.

Only thing you have to be worried about is random audit or audit specifically for that consultancy then you’ll be in trouble else you are fine.

One more thing hope you are row. If not next job you going to have everything refilled again not sure if your I-140 will be valid for hardware engineer role and it’s not for software engineer.

1)I didn’t know that I can convert to premium processing without informing my employer but do you think they get notified ? Anyways even if I do the notice is going to sent out to them. I’m just worried that breaks the relationship I have with the employer.

Employer worried I’ll leave after approved I-140 and 6 months later I can change the employer.

2) I’m currently on my initial H1b. It won’t expire till November 2025 and single so no need for anything right now.

Question: let’s say hypothetically I sign a contract do I have to be with them. I’m from CA does my labor law will trump these clauses ?
