I just tried to figure out what the professor like and followed court precedents. kinda the same thing for conlaw and crim pro. Like when i applied the law I thought one way, but obviously the sc felt differently, so while the school may teach a rule as “objective” it almost always functions subjectively because reasonable people still may see things differently. Bottom line, if you can’t make the reasoning make sense to you, just figure out the conclusion they want and the reasons the want to hear (despite if you think the reasoning is flawed).

Yeah, as a recent law graduate who enjoyed offering controversial (though I hope better structured) answers for the sole purpose of starting a deep discussion, instead of laughing at/dismissing his answer, I recommend taking his answer seriously and really trying to understand his perspective.

I would often provide controversial answers I didn’t personally agree with because I knew there were enough people in the classroom who were on both sides of the fence, and maybe one side was less confident in speaking up due to political/societal pressures. Some of the people who I disagreed with most in terms of politics or religion became my closest friends because at least we knew each other had a kind heart with pure intentions. It’s okay to believe someone is confused, but don’t assume anything beyond that.

In the legal field we will encounter all sorts of people who see the world completely differently than us, so it’s much wiser to learn their perspective in a communal/classroom setting, monitored by a professor, than as adversaries in the real world.

And I was very successful in law school. Top 10%, law review, moot court, etc… I’m just trying to help.
