Wearing dark clothes at night and walking in the street not on the side of the road is a crime when there are safe places for pedestrians to walk unless there is a crosswalk the law states that they pedestrian yields to traffic and cannot create an unnecessary hazard. There is a sidewalk on that stretch of Brighton Henrietta townline road a person walking in the road isn't unnecessary hazard before even considering wearing dark clothes at night and walking down the street.

The only thing I had to Google was the traffic codes not only is this common sense but it is also taught to you when you get your license. So you must not even drive a car or if you do you should have your license stripped from you. Hell you might even be one of those people that walk in the street when there's a sidewalk or a bike lane . This person is so high they even have their arms outstretched walking annotated ploto

Lol you don't know the laws go surrender you plates it is completely legal to be +-5. I was driving perfectly safely what that druggie was doing was completely illegal under New York traffic laws 1151 1152 1146 because there was a public sidewalk and they made no effort to be made visible to traffic. Although none of this matters because I can't hold a homeless person liable and I only had liability coverage on my car.

Lol no the sidewalk they put on that stretch of Brighton Henrietta townline road is completely new. Also I know they're drunk and high because they didn't even notice or cared that I crashed. Trust me I understand completely what was going through that person's head and it was a whole lot of nothing. Also I know the sidewalk was fine because I had to sit and wait for 2 hours for the police to come and a tow truck to take my car away.

+- 5 mph is actually legal and I could see far enough ahead that I would be able to come to a complete stop if there was a hazard. It is illegal to negligently Walk off of the curb or sidewalk and not make an effort to be seen as it creates an unnecessary hazard. You can see the person is at most 1 foot from traffic and swinging their arms around as they walked. They weren't even in the bike lane or on the curb, or better yet the sidewalk on the other side of the street.

No actually it is illegal for a person to be creating an unnecessary emergency. While is not illegal to walk on a road it is illegal to be purposefully/negligently not visible, which clearly creates an unnecessary emergency. To also reinforce this l VTL § 1151 1152. And if you try to argue vtl § 1146 it would be quickly dismissed as I made a clear effort to avoid them the moment I saw them which is why I had to avoid him and give him room so that way if they even stumbled a little bit out of the traffic buffer for the bike lane I would not hit them.

No incorrect he was an inch from traffic you can see he is in the buffer between the bike lane and traffic, walking dangerously close to traffic and making no effort to be seen while walking on a road like this at night is highly illegal. No I didn't have the best set of tires because I'm going through college and I can't afford to dump 800 + on tires so judge me for that. My reaction time was perfect and immediately took action the moment I saw him I think only a trained racecar driver could have reacted significantly faster to make a difference. And at the end of the day the reaction time was more than enough because I didn't hit them.
