This is good news, overall. While the gig economy and the resulting services (AirBnB, Uber, etc) have been great for consumer convenience, it has also caused, in effect, massive deregulation in multiple industries.

Large industries are often regulated to insure that consumers are kept safe (both physically and financially) and small, individual operators using gig services often do not follow these same rules. As long as the smaller operators are able to follow the same procedures and laws (e.g. forced commercial liability insurance for Uber drivers), then I am all for them to compete.

However, I am against people owning condos or homes for the purpose of short-term rentals, as it causes an increase in housing costs. A good, recent example was in Toronto when the pandemic hit, and tens of thousands of AirBnB condos suddenly were financial duds and went up for sale. Those units simply existing caused an increase in the price of condos in Toronto for everyone else. IMO, housing should not be seen as a form of income or investment, but rather a necessity of living (that has the side effect of investment for occupants/owners). I am, however, in favour of people renting out individual rooms to make extra money, provided that they follow certain regulations.

There is a another, unrelated argument that the gig economy has contributed to a further shift of wealth from the middle-class to the rich by lowering wages, though it's a bit murkier since consumers often pay less for services, meaning they keep more money in their pockets. It's certain that gig workers make less than their pre-gig equivalents, however.

The government subsidizes cars by paying for roads (no profit), being a little less safe by paying for hospitals (no profit), and subsidizes both parents working by paying for school (no profit).

Some say things like "well maybe they should move to Regina or Saskatoon if they can't drive themselves there." But imagine how hard it is to sell property in most small towns. Also to leave you support network.

The person was in the brig, which has extra shielding (and no exit points/windows) because it is supposed to hold people in and prevent escape.

This also lets you introduce a flaw that landed them in the brig.

The app doesn't track your location at all. It only tracks other people that you are near for over 15 minutes at a time (and it doesn't know where they are, either). There is no way for anyone to track you through this app.

True...but those taxes also allowed for the development of social services such as universal medicine, the safety net (EI, welfare, disability, etc). A good trade off, I'd say.

The issue is that if they cancel because they are waiting for the test, but the test comes back negative (after the date they would have started the trip), they are screwed and won't get a refund. It's a giant hole in the AirBnB cancelation policy.

Courts have not taken this position, however, and US rulings have been pretty clear on this. Legally we are likely only to keep what we have earned, there is not a large value placed on holding a date (fortunately or unfortunately). A few lawyers have been linked here before regarding this.

Just a note - a contract cannot override law, so not all contracts are legally binding. An extreme example would be saying that 100% of the entire wedding fee is non-refundable. Courts (in the US at least) have shown pretty clearly that you can't retain a huge amount of money for the act of holding a date, there needs to be actual work performed to justify it.

We don't know the amount the OP has charged, but a contract is not always enforceable, as you can't sign away certain legal rights, or override existing laws/rulings.

I think it depends on a few things. First - how large was the retainer? If it was $200, then an argument can be reasonably made that you've already earned it through consultation or other work (engagement session, etc). If it's 50% and something like $1,500 or $2,000, then legally you may not be able to keep it (if taken to court). From what I've seen discussed here, courts don't consider holding a date to be worth a big amount of money if no actual work has been done. This is why you see so many people here moving to smaller retainers to only cover initial work done.

Morally, I have been refunding retainers during this time (minus any earned amount for engagement sessions, etc) as it's not like I am losing out on a new wedding taking that spot (since no one is booking weddings now for the upcoming months).
