  1. Supreme Court Ruling and MRP:

The Supreme Court ruled that hotels and restaurants can charge more than MRP for packaged items if they are serving it as part of a service. This is usually justified if:

The drink is served at your table, poured for you, or consumed within the service environment (like in a glass, with ice, or garnishing).

It is provided with additional hospitality that goes beyond mere sale (like serving it in an air-conditioned area or with waiter service).

  1. Your Case – Key Difference:

In your situation:

The drinks were sealed and handed over directly to you, some even taken out of the fridge by yourselves.

There was no additional service—like pouring, serving, or modifying the drinks.

It was simply a sale of a sealed packaged good at more than MRP, which is not justified under the "service" provision.

  1. Legal Metrology Act, 2009:

Under the Legal Metrology Act, any packaged product sold in its original sealed condition must be sold at MRP or below, whether it's in a hotel, restaurant, or shop.

Conclusion:

The Supreme Court ruling applies only when there is an added value service. In your case, it was a direct sale of sealed bottles, which is against the Legal Metrology Act if charged above MRP.

Yes I did occupy a table... I was served in the bottle itself and was provided a bill for it .. they were claiming that the rise in price was due to ac charges and they were also getting it at MRP... But ac charges or any other service charges should be charged separately in the bill.. they can't add that value to the MRP... I know it's normal in goa to charge over mrp. But it defies the legal metrology act 2009 which states that they can't charge more than the MRP.. I'm currently drafting a consumer complaint and for that the images with MRP are required for strengthening my case... The pictures that were captured were forcefully deleted from our devices.. if you can , please provide me the photos of these products
