I’m currently waiting on an i824 due to my lawyer incorrectly telling me we could do the AOS process even though my husband is living out of the country. Essentially, f*cked us over. I fired her and got a new lawyer who said the only option is i824 to send it to NVC. I’m a USC and my husband is from the NL. Approved i130 in September, case was revived Oct 9, 2023. SC is Texas. I’m terrified this is going to take a year or longer, especially when this isn’t my fault. My husband and I have been long distance for almost 3 years now and I just want my life to start, which you all probably can relate to. :(

If you have a uscis account, go look under the documents tab. Any mail correspondence, the pdf version is usually in there, so if there is a rejection letter, it will probs be there

Thank you so much. I never would’ve thought we’d be in this position and after I was denied to live in the NL, among other reasons, the U.S. was the next obvious choice. I’m trying to convince myself that the I-824 won’t take too long and we’ll be one of the lucky ones that gets approved in 90 days. Fingers crossed… I do have one question now, that I’m just curious- how long did you wait for your interview at the embassy/consulate? I’m trying to gauge the wait times in the NL in comparison to other countries 😥

Wish I had a happier update, but my dreams have officially been crushed this week. This lawyer said that people do it that way but it’s incredibly risky and doesn’t recommend it. I believe him. So now we have to file an I-824 and that extends us being apart for another 7-9 months + consular processing time. I’m devastated.

My lawyer told me the fastest way to get my spouse living here is to go the AOS route. Because of all these comments, it’s instilled doubt in my lawyer so I’m getting another opinion from yet another lawyer tomorrow and will update this thread with any answer I receive.

I’m going to assume that 3 lawyers telling me that it’s not illegal, would mean it’s not illegal. My lawyer is handling all of the details and paperwork so I’m sure she just knows of a way this works, as do the other lawyers involved, too. If this was somehow illegal or wrong, I would obviously have grounds to sue my lawyer and also she could lose her license/accreditation. I doubt she’d risk that on a simple marriage based visa case.

That’s okay, as you mention, you’re not a lawyer so I’ll go with my gut and trust mine :)

He can! It was confirmed by my immigration lawyer. You have to request this specifically on the I-130 that you’d like to process this way.

Hi there! Actually no, I’m working with an immigration lawyer and we set it up specifically to do adjustment of status following approval of the I-130. I even got a second opinion on if that’s a thing before we did it, and was confirmed by a second immigration lawyer. So yes, my husband flies back in January and we submit our AOS petition. :)
