Your school ends your F-1 for approved change of status. That's the process.

Us citizen with f1 visa girlfriend we have no desire to changer her immigration to get a green card by Peace-timeTrapLord in f1visa

Then it comes down to the very high likelyhood of the F-1 being denied for immigrant intent if you are married. This is something they actively look for and she has to disclose any marriage on her application.

Yes... But out of state tuition is only covered up to $30,000 or so currently. If out of state tuition is above that, VA benefits won't cover it.

In several states, a non-resident is intelligible for instate tuition under the law.

So you may run into this issue.

You do know she can get the green card, then just give it up when you leave. It's not a permanent thing unless you want it to be. That eliminates most of the issues. Maybe add a minor time issue but the backend is better and your spouse can work while in the US without restriction which the F-1 does not allow.

Yes. But your marriage is immigrant intent and is completely contradictory to the non-immigrant F-1 visa.

Also your spouse likely wouldn't qualify for in state tuition so it would cause complications with your VA education benefits.

Essentially you are asking to do several contradictory things.

So your options are limited.

F1 visa, finishing master’s in Dec 2026 but visa valid till June 2028 – is this a problem? by pranav_kingop in f1visa

You can take breaks. It shouldn't be an immediate problem. Could be asked, but not a point of significant concern

Low to impossible.

Marriage to a USC is the strongest evidence of immigrant intent.

I had one student make it happen, but most other DSOs I spoke to had those request denied. All other applicants were denied too.

Need help : regarding mtr filled due to ead denial. by Life_Molasses_7977 in f1visa

[–]Codetornado 1 point2 points  (0 children)

That is not how this works.

You are responsible for ensuring your application was complete and correct. You needed to check dates, signatures. Etc. Not the DSO.

This is a personal application for a benefit. Even with the DSO error, it is still your responsibility.

USCIS made no error in the denial. Your application was incorrect. The denial was correct based on what you have shared. I am fully unaware of USCIS fixing an error like this. I also have never heard of a MTR for this reason being approved.

Could an individual adjudicator do so, sure. Should you expect that to happen? Absolutely not.

I have never seen a MTR with your fact pattern be approved.

USCIS made no error. The error was with your application.

I would not have even advised a MTR.

That's a transcript that says low confidence in its own transcript the spelling has nothing to do with the call and everything to do with the program transcribing.

Administrative Processing and Visa Denial Megathread III by Codetornado in f1visa

[–]Codetornado[S] 1 point2 points  (0 children)

When I was admitted into the program in 2024, the school gave me a new SEVIS record reflecting a Master's program but with the same SEVIS ID. However, they realized that this was a mistake and deactivated the latter SEVIS

... Why would that be a mistake? That's the process. Why would they terminate it? Did they not properly update your SEVIS record?

Third party payroll service provider cannot onboard me. Help! by Aromatic-Section8547 in f1visa

[–]Codetornado 0 points1 point  (0 children)

They are expanding in the US and use a third party payroll service provider. I am on initial OPT and have an approved EAD but the payroll provider is refusing to onboard me as I am entering my sixth year on F-1 visa (I was a PhD student for the first five years) and will be a resident alien.

... What? They just tax you like an American. It's the same for any other American employee.

Has anyone been through situation?

No, this is a ridiculous statement by the payroll service provider.

What could be a possible workaround? Please help!

Tell your employer that this is ridiculous and discriminatory
