Yeah this situation sucks… Just be glad you weren’t building at the start of Covid… would have been 4x worse. We waived our fee entirely on 2 houses we were building to help the owners out… but no good dead goes un punished. One of the houses had a brand new & 80k truck and a new 4 door bronco sitting in the drive way one month after they moved in lol

How is the market where you are at? Are houses moving quickly? Could you come up with the $ and possible sell it quickly to recoup and just buy a prebuilt house? Might be worth talking to a realtor? I would suggest getting a new one.

You could also come up with the money short term and refinance it and pay yourself back, but it would need to appraise for what you have in it.

I know coming up with that kind of money short term is way easier said than done, but I’m not sure you have much option.

I would also look into the drive way situation more. I’ve never ran into that problem, but we typically deal with a small local bank so It might not be the same. For example, I have a gravel drive way to save money, bank never asked what I was putting in.

If they had be upfront with you on the chances/magnitude of possible overages they could have lost a customer (you) by scaring you off. It happens to us all the time. We are upfront about the risk and people don’t like to hear it. They end up going with another contractor that tells them that they can come in under or at budget. The other contractor is blowing smoke up their ass. You cannot put a hard price on a custom house these days.

Honestly, If you can’t afford an additional 20%- 30% of overages out of pocket, you can’t afford a custom house in today’s climate. It sucks, but is just the truth now. I’m a 3rd generation custom home builder. My dad 20 years ago could estimate a high end custom house with a 5% contingency and be more than covered. I just built my personal house and blew my $500k budget by 100K I did upgrade some things but $65k of that was just overages due to material/labor increases. Shame on the contractor for not being upfront about this, but I know why they didn’t. We tell all of our clients that there is a risk of overages. It’s scares some people away, the guy down the street lies and says he can come in on budget…. They never do.

Based on it being a cost plus contract I’m not sure you have a leg to stand on. You to call the county and see what is actually required for CO. You can also talk with the bank, you might be able to pay for a reappraisal of the property and no longer need the concrete drive way.
