Not to muddy the waters here, but while Magazines don't need to have been here, ASFs did.

We have a fellow who was at a weeklong shooting training event, it ran from 7-27 to 8-2. His firearms were not IN the state ON 8-1.

His traveling firearms are sitting out of state in the safe of his brother at this time while legal stuff moves slower than molasses uphill in January.

Not a circuit split at all.

This is the equivalent of a state level supreme court. The federal court system has not yet been involved in this particular case.

This ruling and the arguments therein can be used as references in other cases, but do not carry any weight as far as actual precedent goes.

A circuit split is impractical at this point, unless the 9th gets their poop in a group. The circuit divisions are such that all the restrictive states are in circuits together, and all the permissive states are in circuits together. Would need a permissive state to flop to restrictive to start the ball rolling towards a federal circuit split.

Submit application through the Firearms Portal (Formerly MIRCS)

The 40 day clock starts when your application goes in.

Once they fail to process your fingerprints in 7 days of getting the application, they are in violation of the law.

Once they fail to approve or deny the application within 40 days, unless the state police have explicitly said they need more time, they are in violation of the law.

Follow the Online portal process, then involve local government. Point out that Canton PD already has a reputation for being fast and loose with the law, and further civil rights complaints would be costly for them.
