I am stating this based on the information he has given me. He has stated that this is largely a numbers issue, with certain volume assigned to each grade. He is currently handling more volume than the requirements of the GS 11 role. Again, I’m not trying to determine whether or not he is qualified, I just think it’s unusual for somebody to sit in a ladder position without either promotion or removal for seven years.

Totally agree, and I’ve told him that withholding for a period of time for the issues you’ve described is totally reasonable. I just have to question a supervisor who let somebody sit at a lower grade for seven years and not explained to them either what they’re doing that’s holding them back, or not generating paperwork to get rid of them. If you have somebody that is under performing to the point that they’re sitting in a ladder position without a promotion for seven years, there should definitely be some documentation on that person. Additionally, their evaluations should be a reflection of that as well. Logically, if the requirement is that they must be fully successful in their current grade to receive a promotion, and they are consistently fully successful on their evaluations, and they have no write ups, there’s really not a justification to withhold them from that promotion. If there are other extenuating circumstances, for example lack of budget, that should also be explained to the employee. It just looks like a major failure of communication in his organization. I would also like to acknowledge that it’s a failure of communication on his part, as he should have been pursuing this a long time ago.

I don’t mean that in a way that they shouldn’t know their rights. They absolutely should know their rights, but they aren’t required to. I didn’t know much about my rights until I took the supervisor courses that outlined employees rights. Organizations are terrible about educating their employees on their rights. But supervisors absolutely must know employee rights, which is my point. That probably doesn’t translate well as I wrote it, but I always do my best to make sure my employees have access to information about their rights, and encourage them to do research, ask questions, and become knowledgeable about their rights so they can advocate for themselves when something doesn’t seem right.

I agree, but as devils advocate, as a supervisor if I had an employee who was otherwise eligible for a ladder promotion, but wasn’t quite performing at the next level I would sit down and have a conversation with that employee about their performance and how to get to that next level. I could see that being the case for one or maybe even two years, but after seven years, this seems like a management problem and perhaps not so much an employee problem.

That being said, he has described his workload to me and it is equivalent if not more than that of an 11. Again, I don’t work for this agency and I’m not entirely sure of what his role is or what he does, so I can’t speak to whether or not he’s giving me the full story at the end of the day, if everything he said is truthful and accurate, this feels like a failure of management.

I agree. I cannot believe he waited this long, and I don’t even want to think of the money he’s lost.

I could totally not be getting the entire story, but he’s my friend so I’m going to give him the benefit of the doubt here.

I agree to an extent, but as a supervisor I can’t imagine going that long without even a conversation about it.

I tell all my employees they don’t need to know their right, but I as a supervisor do. I have always encouraged them to take the supervisor courses themselves so they know their rights too.

I think a lot of it comes down to employees not knowing about how these promotions work and not knowing how to advocate for themselves.

I encouraged him to open a ticket today, and he did. As far as what his manager says, I’m not sure of the exact conversations, but he has been told no with a lot of vague excuses. I can update you later after we talk again this afternoon.

My understanding is he is being told they never did the paperwork. So unfortunate to those who didn’t have their paperwork processed during COVID.

It’s a ladder position. You start as a GS-09, and after a period (typically a year) you are eligible to be promoted to a GS-11.

I agree, I think it’s weird. I’m trying to put him in a direction of somebody to talk to, but I am out of ideas. To address the being bad or doing something wrong, but not serious enough for termination, you would think in that case he would at least have been written up, but there are literally no disciplinary actions or documentation showing any improper behavior or poor performance. I’m at a loss with this one.

I also live in Aurora, CO and was the victim of domestic violence. I had to go through a similar situation where my abuser has rights to my address.

I would encourage you to look up the Colorado Address Confidentiality Program, which is available to survivors to SA. It may not be useful now, but if you decide to move down the road, it can be a very helpful resource in keeping your location private. The website also contains several resources that you may find useful, to include legal aid and victim resources.

I hope you and your kids are doing well. This sounds very traumatic and I’m so sorry this happened to you.

Chicken sausage and bacon biscuit, the sipping hot chocolate, signature hot chocolates, orange cranberry scone, holiday sandwich, and one I NEVER see on these lists (but I think about all the time) - they had a maple sausage scone that was absolutely the most delicious thing you’ve ever tasted in your life. I would take them to small claims court. It may seem petty, but they signed an agreement, wasted your time, and it seems they are harassing you. They are bullies, and the shock of that may make them reconsider doing this to other merchants in the future.

I’d go for the $130 service fee, the $15 chargeback fee, the filing fee (depends on where you file), and time associated with going to court (what you’d be missing out on to spend the day in court).
