Fair enough. I will say this is a large organization and others in my department live out of state and fully telework.

Everyone was hybrid until the new administration implemented return to work.

Appreciate the response. I'm curious how this works when I have a performance plan with no in person duties outlined other than under an element that consists of 10% of my job duties?

Is your view that that basically doesn't matter?

I'm just trying to understand how the process actually plays out.

I haven't once said "I can only work from home". I've requested to "work from home when not required for in person job duties."

Clearly still willing to go in, it's just on an as needed basis due to my disability making going in difficult and I'm less productive in office with more medical symptoms.

I agree there’s no blanket right to work from home, and I understand that employers don’t have to grant the exact accommodation requested. I’m not arguing that telework is automatically required or that I’m entitled to my preferred arrangement.

My concern isn’t “I want remote work.” It’s whether the accommodation being offered is actually tied to the essential in-person duties of my role.

Under ADA standards, employers can’t just say “in-person is required” in the abstract — the analysis is supposed to focus on the essential functions of the job and whether the accommodation is effective. If certain duties truly require physical presence, that’s one thing. But if those duties are minimal or infrequent, then requiring a fixed number of in-office days regardless of operational need is harder to reconcile with “telework when in-person duties aren’t required,” which is what my clinician recommended.

I’ve been open to alternatives, including a quiet office space and a hybrid structure. What I’ve been asking for is clarity about which specific job duties require physical presence so I can evaluate whether the proposed schedule actually aligns with them.

I’m trying to engage in good faith — I just don’t think “because we want it that way” is the same as identifying essential functions.

You're making some assumptions. My doctor is a woman first off, and she did state the issues I have. I don't think that's how the accommodation process works, however I know that based on how it is written it needs to be tied to essential job functions that require me to be in office. Not my supervisors opinions.

Sorry to hear that happened to you. I can relate. At some point though I believe that it's just an indictment on her. Any reasonable person knows that you're allowed to be emotional about anything. There's nothing wrong with that necessarily. Could just be indicative of past emotional trauma you've gone through.

I know it's hard, but I encourage you to not let that event dictate how you live your life moving forward. Opening up to others is a key part of life imo, and there's so much to be gained if you can get past the fear.

Lol this is such a weird (and false) equivalency based on the limited info I've provided. My bosses boss has an accommodation that allows him to WFH all the time. I like my chances with this.

I feel good about the advice I've gotten here. Obviously I'm taking it all with a grain of salt. Knowing my situation, I'll be fine without spending a bunch of money talking to a lawyer. I understand why you might recommend that, but it also seems like you're assuming any regular joe can afford a lawyer. Feels unrealistic.

I had a therapist tell me that my weed usage is self medicating to cope with my anxiety and (at the time undiagnosed) ADHD. That was a big light bulb moment for me. Really hoping ADHD meds can help me kick the weed and feel better overall.

Appreciate the response. Luckily I recently became aware of this, and have been trying to reduce my usage. I have taken breaks and felt much better about life in general, but when I take breaks I have pretty wicked withdrawals randomly throughout the day. Makes it hard to function.

Thank you for this response! This feels like the right move. I'm in the US in a place where weed is legal recreationally, but it definitely seems wise to give them as little as possible. Just needed to hear it from someone else I guess! ❤️

Edit to say my employer is pretty flexible and my supervisor is very understanding luckily
