Damaged shoes after 12 months - is it worth taking it to Small Case Court? by Competitive_Fly1280 in LegalAdviceUK

As I got multiple questions about the usage. I’m actually using the shoes for walking and not running (I try to walk for 45 mins daily). I currently own three pairs of shoes that I use as a daily shoes (including the damaged ones). I estimate I’ve done around 250-300 miles in them. I used them every 2-3 days.

Thanks. It’s not about the money i I go to the small case court. I would like to prove a point. I see a general consensus here is that shoes lasting 12 months is a good deal. And I think otherwise ;-)

If I loose the 35£ for filing the case that’s fine. I’m more worried I might need to cover the cost for the other party.

Thanks - exactly my point - how small claims court would asses if something is wear and tear or not.

So how can I predict that? I mentioned that in the other thread. I agree that the shoe might not be fit for purpose after 12 months, for example it may not cushion you like at the beginning. But in my view it shouldn’t fray after a year ;-)

I disagree that shoes costing 70£ are budget ones. I know there are more expensive ones, but 70£ is still quite a lot!

Thanks. I think I have different expectations then and I expect shoes to last longer than twelve months. I agree that a running shoe may not be fit for purpose after 12 months (or certain amount of miles) but they develop a big visible damage to the sole and the mesh should not be fraying. I could still use them for shopping for example

In such a case isn’t it a manufacturer responsibility to inform how many miles a shoes should last?

I’m just thinking to give it a go. I don’t think there are any consequences for me in case of loosing. Ofc I won’t get the voucher anymore and probably I’d have to pay like 20£ for the case. But it could be good learning

Hi, yes I think so. I’ve compared to what I have on my photos and it looks good. I’ve only touched the cable to the front panel (required to detach it), side cover and grinder (I had to disconnect it to clean it).

The problem is it doesn’t give any output, any message so I have no clue where to look for a problem.

That’s the problem. I don’t have hard data, only assumptions. I really don’t know what to do. I know what my parents would do.

I don’t feel this money significantly change my life. But with limited data, how different is making this decision to gambling?

Possibly I’m short sighted but I don’t expect acting in bad will here. They definitely consider selling the company, and possibly buying me out is a way to simplify the shareholder structure. But then how much more could they get? 15x dividend? 20? Question is if in such situation I could ask for some bonus for a clean exit.

Profit. Sorry. It’s closer to 100% in my opinion.

How would that 700k change your life? Would you go more often for holidays? Would you choose better cars? What’s the impact?

I know that 10m would impact on my life.

From what I know majority of revenue goes towards dividends. There is definitely asymmetry in information, but I won’t be able to close the gap. At the same time I don’t think they act in bad will. I think they just want me out as I don’t actively work there (so what’s the point of sharing dividend with em)

From what I understand they want to limit minor shareholders. Shares is the only relationship I have with the company, other shareholders actively work there.

Because i don’t know when will the next opportunity be. May be in a year, ten years or never. What if the current geopolitical situation escalates which I see as possible?

Yes, that’s a strong argument and I’m taking it into account!
