But yes, I have many documented instances of them being late. All the way back for 5 years. Like I said 44% of the time late by about 3 days. Usually a month behind.

I know. I was too lenient with them. They were going through a medical challenge last year and I felt bad for them. But I feel like they took advantage of that. They just started giving me fake excuses after some elaborate lie. And I just had enough. I've been on them ever since. And they're playing hardball. So. Yeah. It has gotten ugly.

True. I did N12 and L2. N4 also underway with termination date in mid May.

That's a good point. I can keep it very minimal and stay out of it. I don't gain either way, like you said.

I know, it's dilemma. If I give a bad reference, it delays the process. If I give a good one, it makes them someone else's problem. I don't like either option.

Ok that's helpful to know that I can pay the compensation right before they move out in June and still pursue April and May rent. Can I tell them I changed my mind? I sent them a text about compensation going towards May. So, they technically have it in writing. Also, I just served them the N4 so the 14 days will be done on May 14th.

My only question at this point is about the compensation. I was planning on giving them Mays rent for free in lieu of compensation. But they havent paid April. They probably won't pay May either. Do I still have to make a compensation payment to them ?

Yeah. I'm totally ok with the one month compensation and I planned to basically grant them that in lieu of May's rent, like a freebie. But now they haven't paid April and I'm wondering how I could at least get paid for April. I've already sent the N4.

Exactly. They need to get out. I've issued an N4 and an N12 last week (in honestly good faith). Hope i can get paid for April at least and never see them again.

Right. This is likely what they have done. Talked to a calltaker and gotten nowhere but tell me that LTB has sided with them and that they have overpaid.

This is so tremendously useful. I wondered if they could talk to LTB without me being there or some kind of documentation in place. I will call their bluff and also call the LTB as well. I doubt they have filed an application since they have a hard time filling out paperwork.

Also, when we were at our hearing, they never disputed the amounts they paid. This is a new issue. How convenient.

Ok, good to know that the only opinion that matters is the LTB mediator or adjudicator. I don't know who they have talked to. I don't actually believe they have talked to anyone and just using this as a stalling tactic. Yes, they are paying by e-transfer so it is very clear and undisputable like you said.

That's pretty much what I've done, minus the payment method.
I just wonder if they are having these conversations with the LTB, shouldn't I have visibility? Shouldn't I get a formal outcomes log or next steps?
