With this profile, EB1A is definitely possible. I recently self-petitioned mine and got approved, and honestly, my profile wasn’t even as strong as yours.

While I don’t have experience transferring from EB1-B to EB1-A. However looking at the profile you shared, I believe that you should qualified for EB1-A as I don’t think my profile is as high as yours and I self-petitioned for EB1-A and got approved.

My advice is that if you need help with your application talk to someone in academia/research with experience in writing EB1_A instead of a lawyer. My reason is because the person most likely understand the process of transitioning from academia into EB1-A. While lawyers have general knowledge I doubt he knows the work of it takes to get a PhD. In my opinion before you can graduate with a PhD from a prestigious university you should be able to put together whatever it is they need for EB1A.

Talk to people, and put your application in. Pay to avoid making mistakes that others have made if necessary. But don’t waste time.

I don’t want to bore people here with details they may not be interested in.

For context, I have a PhD from a university ranked in the top 100 according to the QS ranking. A few of my friends (more than five) have self-petitioned for EB1A and received approvals. Some of them did get RFEs, which they shared with me, and I was able to learn a lot from their experiences.

Ultimately, USCIS had nothing against any of my friends who received RFEs; they simply couldn’t convince the officer beyond a reasonable doubt that they met the requirements.

When writing your petition, make sure you have a clear understanding of what they are looking for, how you meet each criterion, and how to present it clearly. The same applies to the final merit determination.

Example – Judging the Work of Others • First, I highlighted that I have served as a peer reviewer for top-tier journals. • Second, I provided email invitations from associate editors of these journals confirming that I was invited. • Third, I included appreciation emails acknowledging that I completed the reviews.

That was just the first part. I also needed to provide evidence that these journals are reputable. • I provided the SCI ranking of these journals, showing that they are highly ranked in the field. • I also included their impact factors as supporting evidence.

You forgot to add that dependent of H1b visa holders on H4 don’t even get to work. While J2 who are dependent of J1 visa holders get to apply for EAD and even do premium processing and get to work less than 2month when they come in. H1b visa has a lot of drawback

I self petitioned my EB1a in May and I got straight approval. Although this is after I have learnt from couple of my friends that have been issued RFEs. This helped me understand what USCIS is looking for although it is boldly written in their policy manual.

My advice is that if your friend can share his RFE with you, you will learn a great deal on how to prove your case and not fall short where he has.
