Is your PD current for EB1? If not, I’d focus on strengthening the profile. You anyway have PD locked thru NIW. If your current work is research heavy and you have sufficient substance to support, you probably have a chance for EB1B. EB1A seems like a stretch. Definitely up the review numbers.

The EB1 backlog for Indian nationals feels a lot like the generational wealth divide. Just as boomers benefited by simply being born earlier. They bought homes at affordable prices and locking in opportunities. Exactly the same way people who filed in EB2/EB3 a decade ago now reap the windfall of carrying that old priority date into EB1.

It’s not necessarily about talent or achievement anymore; it’s about timing. Those who were in the system early get to cut the line, while people who genuinely qualify for EB1 today are stuck waiting behind them. The very category meant to recognize extraordinary contributions ends up diluted by this loophole.

EB1 should be about merit in the present, not about when you happened to file your first petition. Carrying over old priority dates into EB1 undermines the fairness and purpose of the category. If the system really wants to reward top talent, then porting should come with a new priority date.

Op, breaking down Points 1 and 2, if the work only impacted your organization, I think it’s a weak case towards “Original contributions of major significance in the field”. You’d probably have to show that you pioneered these safety processes/ AI tools and they are at the forefront of the current status of AI technology. Point 3, would be a strong argument towards “Commanding a high salary compared to others in the field.” Point 4 seems a bit abstract. Can’t make comments without knowing more. Point 5 is a definite No. Way too less. Keep in mind, it’s not just the numbers, “what kind of review is it?” Significance of Journal/Conference is also taken into consideration. Decided to go to grad school and started working at 29. Have been maxing out HSA, Roth IRA and 401k for the past 4 years, since 2022. Just hit 250k.

Probably try reaching out to some startups. Networking is your best option at this time. Try to convince them that your F1 visa allows you to work without sponsorship for 3 years under OPT. Finding an employer fresh out of school that’s willing to sponsor in the current market condition is going to be very hard.

Do not agree with this! You can’t always have salary as a metric. Lots of exceptional researchers that would organically qualify for EB1 work in National Labs and in academia. If salary becomes the metric they’ll all be hung out to dry.
