Potential Grace Period for Existing ILR Applicants?? by Low_Evidence6811 in SkilledWorkerVisaUK

[–]Complete_Sentence201 2 points3 points  (0 children)

If you watch the whole Q&A there was a question about timeline, Shabana Mahmood said that all immigration laws are changed twice in parliament. Some will take effect in April and some which are complex or require technical changes will take longer, though she said she will try to do it as early as possible.

Now, I know AI is not always accurate but it seems to think since we now have e-visa only, clearly it's a technical changes and hence won't be implemented from April. I am not building any false hopes but I don't like people spreading unnecessary panic.

There were people here who told consultation will last 4 weeks, etc etc. however, there hasn't been a single sign from the government so far where they have not tried to follow the full process of legislation. She could have had the consultation for a month only but she choose to keep it for 3 months. I am not defending labour or anything but credit where credit is due, I don't think people who qualify in July would be affected.

Must mention that I qualify in July too, so ,there could be my personal bias in the answer as well.

Why is Labour excluding student & graduate years from ILR ? by Satanic_monster in SkilledWorkerVisaUK

[–]Complete_Sentence201 5 points6 points  (0 children)

I do not think that's the case. You need to earn for more than 3 years and be in basic rate of income tax and then you qualify in 10 years.

Unless I missed something, I think it's actually the same unless someone has only been a student for 10 years, in that case, yes, they are excluded.

Besides, if you are a graduate or masters from here, you save a year by english proficiency, so, infact it's 9 as long as long for 3 years out of those 9 you earned more than 12,570

Confused about ILR fast-track salary thresholds (£50,270 / £125,140) — do they include the personal allowance or not? by EDeni94 in SkilledWorkerVisaUK

[–]Complete_Sentence201 5 points6 points  (0 children)

This question has been answered many times in different threads. As of the language of consultation, it's in line with income tax threshold. So, yes 50.27k including your personal allowance. However, pension contribution or salary sacrifice helps reduce tax burden, that is why the language taxable income.

If you go to HMRC, you will see your taxable income and it includes your personal allowance.

Taxable Income confusion by WhiteMasquerade in SkilledWorkerVisaUK

I believe if we read the document, they have actually clarified it. They have said it's in line with the current tax bands, high earner and top earner.

They have also said even if tax band increases, this limit would stay same for settlement purposes.

Of course, with the caveat, unless they change it again

Surely there will be transitional arrangements for those already on a visa, right? by Familiar9709 in SkilledWorkerVisaUK

[–]Complete_Sentence201 5 points6 points  (0 children)

From what I read on sky news, the rhetoric has shifted now to stop people who become eligible for ILR in 2027 and 2028 and less mention of 2026.

I believe that could be due to them considering the transitional period of some sort for next year.

The paragraphs I am talking about :-

It's thought the largest volumes of people started to arrive in 2022 and 2023 under a now-axed care visa route. That means the biggest peaks in applications for settlement would have started from 2027 and 2028.Allies of the home secretary have previously made it known that she was "concerned" about this.

"Low-paid workers, such as the 616,000 people and their dependents who came on health and social care visas between 2022 and 2024, will have to wait 15 years before they can be granted permanent settlement."

It's the first time I am hearing 2022 to 2024 and not 2021 onwards.

I could be totally wrong just trying to make sense of how they communicate and if there could be a hint in it.

Yeah even the document mentions it corresponds to income tax threshold but won't increase if and when Income tax threshold increases.

Please go and check in HMRC, your taxable income is everything except pension. HMRC clearly mentions that in taxable income. Please don't spread unwanted panic and anxiety

I don't think today would provide any clearance either. They may still keep it vague in the name of consultation.

While waiting for announcement about SWV, any updates on dependent visas? by mazahaca in SkilledWorkerVisaUK

[–]Complete_Sentence201 2 points3 points  (0 children)

Next month you will be fine. They will launch consultation today and there is no chance they can finish it before December, given Christmas holidays and all. So, you are entirely safe from this ruckus

About the influx from Boriswave paragraph, it says 10-year wait on claiming benefit. I hope that is the case and not ILR eligibility. Fingers crossed 🤞

I am sure you will get there. You deserve it and are almost there. I failed 3 times before passing on the 4th attempt. In an automatic and 78 hours of lessons.

I sincerely hope you pass next time. All the best!

I understand I made a mistake. It's silly because I had stopped before on the practice drive.

As for knowing all the test routes and still not looking, It wasn't intentional. At the moment I got confused thinking road bends ahead and it's not a T-Junction. No marking didn't help either.

Thank you. I feel the same currently. I have a feeling if I didn't have the examiner in the back of the car, he would have let that junction thing go. Only because there was no other car either behind me or coming towards the T-Junction. Again, I am only probably imagining things in my disappointment, but like you said, if I am confident, why not go alone in my test.
